PENALTIES

17-72-010 Penalties.
A. In addition to any other remedy or penalty specified for a violation of any particular provision of this title any person violating any provision of this title shall upon a finding of guilty, be subject to a fine for each offense as set forth in subsection C of this section, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
B. Nothing in this title shall prevent the city from taking any action available under the municipal code to ensure the health, safety and public welfare of the residents of Harvey. Further, nothing in this title shall prevent the city from taking any emergency action permitted by law when any portion of a rental structure will impose imminent danger to a person or property.
C. Fines. If violations are not corrected within the specified time, the owner may be subject to a one hundred fifty dollar ($150.00) fine that will accrue monthly until the violations are corrected. If the owner fails to pay the fines within three months, the fines will be doubled, the account will be sent to a collection agency and a lien will be placed on the property. In addition, the owner may receive citations on a property, which may subject him or her to fines up to five hundred dollars ($500.00) per day for each day the violations exist.
