32.01 DEPARTMENT CREATED.

There is hereby created a Police Department, an executive department of the city. The Police Department shall consist of the Chief of Police who shall be an ex-official City Marshall, a sergeant, and such other members as may be provided for from time to time by the Mayor and the City Council.

32.02 CHIEF OF POLICE; POWER TO MAKE RULES AND REGULATIONS.

(A) There is hereby created the office of Chief of Police. The Chief of Police shall be appointed at the first City Council meeting in the month of May, and annually thereafter; by the Mayor, by and with the consent of the City Council. (’81 Code, § 5.06)

(B) The Chief of Police may make such rules and regulations for the guidance of the members of the Department as he shall see fit, subject to approval by the Mayor and City Council. (’81 Code, § 5.08)

32.03 QUALIFICATIONS OF MEMBERS.

(A) No person shall be appointed to a full-time position on the Police Department unless he or she shall at the time of appointment be a graduate of the Police Training Institute (PTI) or has signed an agreement with the city that provides that the city will pay the costs for PTI training; and that should the appointee voluntarily terminate the employment within one year from date of completion of PTI, the appointee shall reimburse the city for the total costs expended by the city for such person’s PTI training. If the appointee voluntarily terminates employment within his or her second year following completion of PTI training, the appointee shall pay to the city an amount equal to 1/12 times the number of months remaining in the second year of service of the total costs incurred by the city for such PTI training.

(B) Whenever there exists on the Police Department a full-time vacancy, current part-time appointees shall be given first consideration for the full-time vacancy. The Council reserves the right to hire any qualified individual notwithstanding the preceding sentence. Part-time appointees are not required to be PTI trained.

32.04 BOND.

Each member of the Police Department, before entering upon his duties, shall execute a bond to the city in the penal sum of $500, conditioned for the faithful performance of his duties and the payment of all monies that may be received by him.

32.05 DUTIES; CONDUCT OF MEMBERS.

(A) The members of the Police Department shall enforce all ordinances of the city, all statutes effective in the city, preserve order, prevent infractions of the law, and arrest violators thereof. Every member of the Police Department is hereby declared to be a conservator of the peace. (’81 Code, § 5.04)

(B) It shall be the duty of every member of the Police Department to conduct himself in a proper and law abiding manner, and to avoid the use of unnecessary force. (’81 Code, § 5.07)

32.06 ARREST WITHOUT WARRANT.

The members of the Police Department shall have the power to arrest, with or without process, any person within the city who shall break the peace or who is found violating any ordinance of the city or any criminal law of this state, and to commit such person for examination and, if necessary, to detain such person overnight or Sunday in the county jail or other secure place until he can be brought before the proper judge or court.

32.07 APPOINTMENTS AND PROMOTIONS.

Appointments to and promotions within the Police Department shall be made by the Mayor with the advice and consent of the City Council.

32.08 AUXILIARY POLICEMEN.

The Mayor, with the approval of the City Council, may appoint any reputable person as an Auxiliary Policeman to serve for such term and on such conditions as may be designated by the terms of such appointment. Auxiliary Policemen shall receive no compensation from the city, unless such compensation is ordered by the City Council. Appointments may be revoked at any time by the Mayor, or Chief of Police, by and with the consent of the City Council.

32.09 PART-TIME POLICE.

(A) Employment. The City Council of the City of Lewistown, along with the advice of the Chief of Police, may employ part-time police officers from time to time as it deems necessary and appropriate.

(B) Duties. A part-time police officer shall have all the responsibilities of a full-time police officer and such specific duties as delineated in the general orders of the Lewistown Police Department, but the number of hours a part-time officer may work within a calendar year is restricted. Part-time police officers shall not be assigned to supervise or direct full-time police officers. Part-time police officers shall be trained in accordance with the Illinois Police Training Act (50 ILCS 705/1 et seq.) and the rules and requirements of the Illinois Law Enforcement Training and Standards Board.

(C) Hiring standards. Any person employed as a part-time police officer must meet the following standards:

(1) Be of good moral character, of temperate habits, of sound health, and physically and mentally able to perform assigned duties.

(2) Be at least 21 years of age.

(3) Pass a medical examination.

(4) Possess a high school diploma or GED certificate.

(5) Possess a valid state of Illinois driver’s license.

(6) Possess no prior felony convictions.

(7) Any individual who has served in the U.S. military must have been honorably discharged.

(D) Discipline. Part-time officers shall be under the disciplinary jurisdiction of the Chief of Police. Part-time police officers serve at the discretion of the city authorities, shall not have any property rights in said employment, and may be removed by the city authorities at any time. Part-time police officers shall comply with all applicable rules and general orders issued by the Police Department.
