73-1.10 DEFINITION.

NONHIGHWAY VEHICLE. Any vehicle not otherwise designed for use upon the roadways but capable of being operated safely upon those roadways in accordance with Chapter 11 of the Illinois Vehicle Code, “Rules of the Road” (625 ILCS 5/11-100 et seq.), with not less than four nor more than six wheels that conforms to § 73-1.30.

73-1.20 NONHIGHWAY VEHICLES PERMITTED.

The operation of certain nonhighway vehicles shall be permitted on streets under the sole jurisdiction of the City of Lewistown and within its corporate boundaries where the posted speed limit is 35 miles per hour or less, as set forth in this section. Nonhighway vehicles shall be permitted to cross any street at an intersection where the street being crossed has a posted speed limit of not more than 35 miles per hour.

73-1.30 COMPLIANCE WITH ILLINOIS VEHICLE CODE.

(A) The operation of nonhighway vehicles within the City of Lewistown shall be in accordance with all provisions of the Illinois Vehicle Code (625 ILCS 5/1-100 et seq.), including Chapter 11 thereof, “Rules of the Road” (625 ILCS 5/11-100 et seq.). All nonhighway vehicles must have, at a minimum, the following equipment:

(1) Brakes;

(2) Steering wheel or other nonhandlebar steering apparatus;

(3) Bench or bucket-type seat(s);

(4) Tires;

(5) Rearview mirror;

(6) Horn;

(7) Red reflectorized warning devices in the front and rear of the vehicle;

(8) Slow moving emblem;

(9) A headlight that emits a white light visible from a distance of at least 500 feet to the front of the vehicle;

(10) A taillight that emits a red light visible from a distance of at least 100 feet from the rear of the vehicle;

(11) Brake lights visible from the rear of the vehicle; and

(12) Turn signals visible from the front and from the rear of the vehicle.

73-1.40 PERMITS.

(A) No person shall operate a nonhighway vehicle within the City of Lewistown without first obtaining a permit, or being listed as an additional operator under a permit, as provided herein. The cost of the permit shall be $25. Applications for a permit shall be made on a form supplied by the City of Lewistown, shall be executed by the applicant and each additional operator and shall contain the following:

(1) Name and address of applicant;

(2) Name and address of any additional operators;

(3) Name of liability insurance carrier and policy number;

(4) Serial number, make, model and description of vehicle;

(5) Waiver of liability; and

(6) Such other information as the city may require.

(B) No permit shall be granted unless the following conditions are met:

(1) The vehicle must be inspected and approved by City of Lewistown personnel;

(2) The applicant must provide evidence of insurance in compliance with the provisions of the Illinois Statutes regarding minimum liability insurance for passenger motor vehicles to be operated on the roads of the State of Illinois;

(3) The applicant must provide a copy of the driver’s license of the applicant and each operator.

(C) A new inspection and permit shall be required for each nonhighway vehicle. No permit may be transferred from one nonhighway vehicle to another without first obtaining approval from the City of Lewistown.

(D) The City of Lewistown will recognize permitted nonhighway vehicles from other municipalities and villages requiring compliance with the Illinois Vehicle Code (625 ILCS 5/1-100 et seq.).

(E) Temporary Permits. Individuals may apply for and obtain a temporary nonhighway vehicle permit for authorization to operate a nonhighway vehicle on streets under the sole jurisdiction of the City of Lewistown for a period of up to ten days for a $5 fee. Individuals applying for a temporary permit under this section shall provide all information required under this section to the City Clerk, shall verify that the nonhighway vehicle to be operated is compliant with the Illinois Vehicle Code (625 ILCS 5/1-100 et seq.) and shall permit inspection of the vehicle by City of Lewistown personnel upon request.

73-1.50 ADDITIONAL REQUIREMENTS.

The following requirements shall apply to the operation of nonhighway vehicles within the City of Lewistown:

(A) The applicant and all operators must possess a valid driver’s license issued in his or her name by the Secretary of State or foreign jurisdiction.

(B) At any time between one-half hour before sunset and one-half hour after sunrise, the vehicle’s headlight and taillight shall be lit when the vehicle is in use.

(C) A city decal evidencing that a permit has been obtained shall be displayed on the nonhighway vehicle in the center of the slow moving emblem.

73-1.60 VIOLATIONS.

Any person who violates the provisions of this section or any section of this code by operating a nonhighway vehicle shall be subject to revocation of permit or nonrenewal of permit at the discretion of the City Council, a monetary fine, and/or other appropriate penalty as prescribed by the section containing the provision that was violated.
