10.77.010 Purpose.

The purpose of this chapter is to alleviate the effects of loud music and noise coming from car stereos and boomboxes which disturb residents of the village in their quiet enjoyment of their homes or their ability to safely operate a motor vehicle. Furthermore, efforts aimed at eliminating excessive noise through traffic and ordinance violations have not been a significant deterrent. (Ord. 99-47, 1999)

10.77.020 Definitions.

The following definitions shall apply in the interpretation and enforcement of this chapter:

A. “Person” means any person, firm, partnership, association, corporation, company or organization of any kind.

B. “Property” means any real property within the village which is not a street or highway.

C. “Street or highway or public way” means the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.

D. “Vehicle” means a machine propelled by power other than human power designed to travel along the ground by use of wheels, treads, runners or slides and transport persons or property or pull machinery and includes, without limitation, automobile, truck, trailer, motorcycle, tractor, buggy and wagon. 10.77.030 Sound device restrictions.

A. Broadcast Sound Restrictions. No person shall play, use, operate or permit to be placed, used or operated, any radio, tape recorder, cassette player or other device for receiving broadcast sound or reproducing recorded sound if the device is located:

1. On the public way or upon private property;

2. In any motor vehicle on the public way or upon private property if the sound generated by the device is clearly audible to a person with normal hearing at a distance greater than seventy-five feet. This section shall not apply to any person participating in a parade or public assembly for which a permit has been obtained pursuant to village code.
