10.10.010 Duties of Police and Fire Departments.

(A) It shall be the duty of the Police Department to enforce the street regulations of this city and all state vehicle laws applicable to street traffic in the city; to make arrests for traffic violations; to investigate all traffic accidents and to cooperate with other officials of the city in the administration of the street traffic laws and in developing ways and means to improve traffic conditions and to carry out those duties specially imposed by this title and other traffic ordinances of the city.

(B) It shall be the duty of the officers of the Police Department or such officers as are assigned by the Chief of Police to enforce the street traffic regulations of the city and the state vehicle laws applicable to street traffic in the city.

(C) Officers of the Fire Department, when at the scene of a fire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. [Code 2000 § 70.55; Code 1981 §§ 10.04.030 and 10.04.110.]

10.10.020 Traffic Commission.

There is established a Traffic Commission to serve without compensation, consisting of the Mayor, a member of the Common Council selected by the Mayor, City Engineer, Chief of Police or representative, and Street Commissioner. The chair of the Commission shall be the Mayor. [Ord. 1022-2000. Code 2000 § 70.56; Code 1981 § 10.04.080.]

10.10.030 Emergency and experimental regulations.

The Chief of Police is empowered to make regulations necessary to make effective the provisions of the traffic regulations of the city and to make and enforce temporary or experimental regulations to cover emergencies or special conditions. No such temporary or experimental regulations to cover emergencies or special conditions shall remain in effect for more than 90 days. [Code 2000 § 70.57; Code 1981 § 10.04.090.]

10.10.040 Identifying insignia for funeral processions.

The Police Department shall designate a type of pennant or other identifying insignia to be displayed upon, or other method to be employed to identify, the vehicles in funeral processions. [Code 2000 § 70.58; Code 1981 § 10.04.100.]

10.10.050 Accident and violation records – Annual traffic report.

(A) The Police Department shall maintain a standard system of filing traffic accident reports by location and shall maintain suitable files and records showing the types and number of traffic accidents, the arrests and warnings issued to traffic law violators. The Police Department shall also maintain spot maps showing the type and location of traffic accidents.

(B) The Police Department shall annually prepare a traffic report which shall be filed with the Mayor and the Council. The report shall include all information pertinent to the number of traffic accidents, accident trends, the number of accidents investigated, arrests made as a result of such investigation, the number of moving traffic violation arrests, the number of parking violation arrests and other data on the traffic activities of the Department. 10.10.060 Citation and arrest procedures.

(A) Forms. The city shall provide, in duplicate, suitable serially numbered forms for notifying violators to appear and answer to charges of violating traffic laws and ordinances. The forms shall be issued to the violators, or owners of vehicles in violation, by police officers. Traffic violations charged as a violation of the state statute will require forms as prescribed by the Indiana Code.

(B) Parking Violation Notice Procedure. Any city police officer, when issuing a notice of a parking violation, shall prepare in duplicate, and containing the date of violation, the registration number of the motor vehicle involved, the hour of the violation, and the violation charged, and issue to the violator, or conspicuously affix to such unattended vehicle, for its user, a serially numbered notice to answer the violation charged, at the time and place designated thereon. The original of such notice shall be retained by the Police Department.

(C) Failure to Comply or Appear – Filing of Complaint. In the event that any person fails to comply with a notice given to such person or attached to a vehicle for such person, or fails to make an appearance pursuant to a summons, the City Attorney shall cause a complaint to be filed and entered against such person in the appropriate court of law. 10.10.070 Penalty.

Unless another penalty is expressly provided by law or by this chapter, any person violating any provision of this title is guilty of an offense, and upon conviction shall be fined as provided in Chapter 1.15 AMC. [Ord. 1052-2001. Code 2000 § 70.99; Code 1981 § 10.60.010.]
