10.40.010 Definitions.

For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning:

“Eligible Highland resident” means a person or persons who by virtue of their age as set forth in this chapter or their disability find travelling difficult on public transportation and have no meaningful access to alternative transportation.

“Qualified Highland resident” means a person or persons who applied as eligible Highland residents and were approved for the participation in the transdiscount program and have been issued an appropriate identifying article for participation as provided in this chapter.

“Trip” is a journey of a qualified Highland resident taken with a participating private taxicab or livery offering rides for hire, from a single origin to a single destination. [Ord. 1194 § 2, 2002. Code 2000 § 174.01].

10.40.020 Service established.

In order to complement existing demand response public transportation service choices and to augment those services that do exist for certain residents of Highland, there is hereby established a special program called the transdiscount service. [Ord. 1194 § 2, 2002. Code 2000 § 174.02].

10.40.030 Administration – Eligible users of service.

The clerk-treasurer or his designee is hereby authorized and empowered to administer this program according to this code as follows:

(A) In order to effect a discount to the cost of using a taxi or other livery service for hire, a subsidy may be made available for eligible Highland residents who are either:

(1) Sixty-five years of age or older; or

(2) A person with a disability;

(B) In order to be qualified, the eligible Highland resident must complete an application for services and be approved as qualified for the program;

(C) The form of application shall be approved by the clerk-treasurer, pursuant to IC 36-5-6 et seq., and will include a proper certification by the applicant;

(D) Once approved as qualified, some identifying article shall be issued in support of participation in the program;

(E) Once approved, qualified Highland residents need not reapply except to renew any identifying article issued in consequence of the program;

(F) Any identifying article may only be used by the qualified Highland resident to whom it was issued and may not be transferred or loaned to anyone for any reason. [Ord. 1194 § 2, 2002. Code 2000 § 174.03].

10.40.040 Operation of subsidy.

(A) The town of Highland through its transdiscount service will provide to a qualified Highland resident a subsidy of one-half the cost of any fare imposed for a trip that either originates in Highland or ends in Highland; provided, that the subsidy for any trip shall not exceed $5.00;

(B) The subsidy will be paid directly to any participating taxicab or livery for hire, provided as follows:

(1) The participating taxicab or livery for hire agrees to the terms and conditions of payment by the municipality under this program;

(2) The participating taxicab or livery for hire agrees to the terms and conditions of the transdiscount service as a program of the municipality, which may include registering as a participating provider in the program;

(C) Payments under the program may only be made from a lawful appropriation of the town, identified for the purpose of this subsidy;

(D) The clerk-treasurer may prepare written guidelines, setting forth reasonable terms and conditions as mentioned in subsection (B) of this section, not inconsistent nor in conflict with this chapter and in support of carrying out its purposes. [Ord. 1194 § 2, 2002. Code 2000 § 174.04].

10.40.050 Participation as a privilege – Suspension from participation.

(A) Participation in the transdiscount service shall be construed as a privilege and participation may be suspended, denied or barred for any one of the following reasons:

(1) If the appropriating authority fails to appropriate sufficient funds in any given year to support the program;

(2) If a participating provider violates or refuses to comply with terms, conditions or guidelines of the program;

(3) If a participating resident permits someone to use their identifying article, fails to comply or violates any provisions of the program under this chapter. [Ord. 1194 § 2, 2002. Code 2000 § 174.05].
