ARTICLE I. PARKS AND RECREATION DEPARTMENT

15.04.010 DEPARTMENT CREATED.

Under the provision of I.C. 36-10-3 there is hereby created a municipal Department of Parks and Recreation. (Ord. passed - -; Am. Ord. 15-04-010 § 1, passed 6-20-2011. Prior Code, Title 15, § 1)

15.04.020 COMPOSITION OF BOARD.

A Parks and Recreation Board shall be composed of:

Four members appointed by the executive on the basis of their interest in and knowledge of parks and recreation. No more than two members shall be of the same political party.

Additional members shall include:

A member of the governing body of the school corporation selected by that body, or designated by the governing body of the school corporation. Ex officio members have all the rights of regular members, including the right to vote. A vacancy in an ex officio position shall be filled by the appointing authority.

All members of the Board must be members of the District.

Neither a municipal executive nor a member of a county fiscal body, county executive, or municipal fiscal body may serve on a Board. (Ord. passed - -; Am. Ord. 15-04-010 § 2, passed 6-20-2011. Prior Code, Title 15, § 2)

15.04.030 TERMS.

Upon establishment of the Board, the terms of its members shall be as follows:

(A) One member for a term of one year.

(B) One member for a term of two years.

(C) One member for a term of three years.

(D) One member for a term of four years.

As a term expires, each new appointment shall be made by the mayor for a four-year term. All terms expire on the first Monday in January, but a member shall continue in office until his or her successor is appointed. If an appointment for a new term is not made by the executive by the first Monday in April, the incumbent shall serve another term. If a vacancy occurs, the executive shall appoint a new member for the remainder of the unexpired term. (Ord. passed - -; Am. Ord. 15-04-010 § 3, passed 6-20-2011. Prior Code, Title 15, § 3)

15.04.040 PRESIDENT; VICE-PRESIDENT.

At its first regular meeting in each year, the Board shall elect a president and a vice-president. The vice-president shall have authority to act as the president of the Board during the absence or disability of the president. 15.04.050 POWERS.

The Board shall have the power to perform all acts necessary to acquire and develop sites and facilities and to conduct such programs as are generally understood to be parks and recreation functions. In addition, the Board shall have all the powers and duties listed in I.C. 36-10-3 et seq. (Ord. passed - -; Am. Ord. 15-04-010 § 5, passed 6-20-2011. Prior Code, Title 15, § 5)

15.04.060 ANNUAL BUDGET.

The Board shall prepare and submit an annual budget in the same manner as other departments of City government as prescribed by the State Board of Accounts. ARTICLE II. PARK RULES

15.04.070 FEES.

All fees for programs and use of parks grounds shall be set by the Board. (Reference in I.C. 36-10-3-22.) (Ord. 15-05-02 § 1, passed 5-18-2015)

15.04.080 HOURS.

The operational hours for the park will be dawn to dusk. (Ord. 15-05-02 § 2, passed 5-18-2015)

15.04.090 PROHIBITED CONDUCT.

(A) Sleeping in the park is prohibited.

(B) It shall be unlawful for any person to consume or possess an alcoholic beverage or be under the influence or effect of alcohol in the park or other premises or places under the jurisdiction or control of the Board. (Ord. 15-05-02 § 3, passed 5-18-2015)

15.04.100 PENALTY.

A person who violates any provision of this article shall be guilty of an infraction punishable by:

(A) A penalty of $75 for a first violation;

(B) A penalty of $100 for a second violation within a 12-month period;

(C) A penalty of $150 for each additional violation within a 12-month period;

(D) Penalties shall be processed through the Southport Ordinance Violations Bureau. (Ord. 15-05-02 § 4, passed 5-18-2015)
