CRIME INSURANCE COVERAGE

2.92.010 Established - Provisions.

A.    All county officers, employees and other persons acting on behalf of county who are required by I.C. 5-4-1, or any other statute, ordinance or resolution, to file individual surety bonds may, after the effective date of this ordinance, be covered by a crime insurance policy;

B.    Any crime insurance policy purchased by Vanderburgh County pursuant to this ordinance shall, at a minimum, cover the faithful performance of the duties of officers, employees, or other persons acting on behalf of county, including the duty to comply with I.C. 35-44-1-2, and the duty to properly account for all monies and property received by virtue of that person’s position or employment;

C.    Any crime insurance policy purchased pursuant to this ordinance shall comply with the form of crime insurance policy prescribed by the Indiana Commissioner of Insurance, in consultation with the commission on public records under I.C. 5-15-5.1-6;

D.    Any crime insurance policy purchased pursuant to this ordinance shall comply with all minimum and minimum amounts of coverage, and shall be endorsed, approved, certified, recorded and filed in the same manner as prescribed by I.C. 5-4-1, or any other statute, ordinance or resolution;

E.    The coverage under any crime insurance policy purchased pursuant to this ordinance is not void on first recovery, and suits may be brought under the policy until the penalty is exhausted;

F.    Any crime insurance policy purchased pursuant to this ordinance shall be given the same effect as any independently approved individual bond required by any statute, ordinance or resolution, as it relates to the amount and term of a bond for a particular office, place of filing the bond, and the necessity of a bond as part of qualifying for office; and,

G.    Any crime insurance policy purchased pursuant to this ordinance must comply with all conditions of this ordinance, and said purchase must first be authorized by an ordinance of the council, as the fiscal body of county pursuant to I.C. 5-4-1-18(b).
