CITY OF EVANSVILLE OPIOID RESTRICTED DONATION FUND

3.31.010 Creation of the City of Evansville Opioid Restricted Donation Fund.
The Vanderburgh County Auditor shall establish a fund entitled “City of Evansville Opioid Restricted Donation Fund” and shall deposit all settlement proceeds transferred, donated, or granted from the City of Evansville’s opioid settlement account distribution into such funds.

3.31.020 Purpose of the City of Evansville Opioid Restricted Donation Fund.
The purpose of the City of Evansville Opioid Restricted Donation Fund shall be to receive the restricted funds from the City of Evansville’s opioid settlement account distribution and to provide said funds for the costs associated with the VCSO mental health programs and the Integrative Recovery and Community Support (IRACS) program. These funds may only be used for programs of treatment, prevention, and care that are best practices as defined or required by the settlement documents, court order, or pursuant to the Opioid Litigation and Settlements law, I.C. § 4-6-15 et. seq.

3.31.030 Appropriation of funds.
The City of Evansville Opioid Restricted Donation Fund shall require appropriation by the Vanderburgh County Council, and such monies shall be spent in accordance with the general rules as to which other Vanderburgh County funds are subject. Additionally, if required by the Vanderburgh County Council, a salary ordinance shall be created when necessary to allow for personnel expenses to be paid from revenues in the City of Evansville Opioid Restricted Donation Fund. Pursuant to the Opioid Litigation and Settlements law, I.C. § 4-6-15 et. seq., Vanderburgh County shall monitor the use of those funds and provide an annual report to the office of the secretary of family and social services not later than a date determined by the office of the secretary of family and social services.

3.31.040 Investment and restriction of the City of Evansville Opioid Restricted Donation Fund.
All payments deposited into the City of Evansville Opioid Restricted Donation Fund shall be invested and reinvested pursuant to standard procedures followed by Vanderburgh County, and said funds and interest derived there from shall remain restricted pursuant to the approved uses of the Opioid Litigation and Settlements law, I.C. § 4-6-15 et. seq., and at the end of each year, shall remain within such funds.
