VANDERBURGH COUNTY SHERIFF’S OFFICE SEIZED FUNDS ACCOUNT

3.33.010 CREATION OF THE VANDERBURGH COUNTY SHERIFF’S OFFICE SEIZED FUNDS ACCOUNT.

The Vanderburgh County Auditor shall establish a fund entitled “Vanderburgh County Sheriff’s Office Seized Funds Account” and shall deposit all money recovered pending a final disposition of the related criminal matter.

3.33.020 PURPOSE OF THE SHERIFF’S OFFICE SEIZED FUNDS ACCOUNT.

The purpose of the Vanderburgh County Sheriff’s Office Seized Funds Account shall be to deposit the funds remaining in evidence recovered from investigations. The VCSO shall hold the funds for the applicable amount of time required pursuant to I.C. §35-33-5-5, which requires law enforcement agencies to retain seized funds pending a final disposition of the related criminal matter. Prior to transferring from the funds from evidence, VCSO shall maintain certified records of the disposition including a record of the preserved evidence, a disposal date for the preserved evidence, and notice to the last known address of the defendant and the defendant’s attorney identifying when the preserved evidence is removed from its secure location; or of the date the preserved evidence has been marked for disposal. If the law enforcement agency responsible for disposing of property does not have the defendant’s or the defendant’s attorney’s most current address on file, then the notice requirement is deemed waived.

3.33.030 APPROPRIATION OF FUNDS.

The Vanderburgh County Sheriff’s Office Seized Funds Account shall function as a non-reverting, non-interest-bearing custodial account, and will be reconciled monthly in compliance with SBOA guidelines. Appropriate internal controls and case-level tracking will be maintained by the Vanderburgh County Sheriff’s Office.

3.33.040 INVESTMENT AND RESTRICTION OF THE VANDERBURGH COUNTY SHERIFF’S OFFICE SEIZED FUNDS ACCOUNT.

All payments deposited into the Vanderburgh County Sheriff’s Office Seized Funds Account shall be held and maintained pursuant to standard procedures followed by Vanderburgh County, and said funds pursuant to disposition under I.C. §35-33-5-5 et. seq., at the end of each year, or more frequently pursuant to SBOA guidelines.
