10.80.010 Driving Past Barricades or Removal of Barricades.

(A)    No person shall operate a motor vehicle around or past a barricade when such barricade indicates that there is “High Water”, “Street Closed”, “Road Closed”, “Motor Vehicles Prohibited”, “Do Not Enter”, “Traffic Prohibited” or similar wording indicating that vehicles are prohibited, within such area, unless an authorized individual has permission to drive past the barricade. The term “authorized individual” shall include, but is not limited to, any emergency personnel, any Vanderburgh County employee or official, or any person authorized to close the street or road and place a barricade within the affected area.

(B)    If a person is authorized to drive past a barricade and the street or road is covered with water, such person shall drive at a slow rate of speed so as to create a minimal or no wake or wave of water.

(C)    No person shall cause the removal of a barricade except as authorized by or directed by Vanderburgh County emergency personnel, a Vanderburgh County employee or Vanderburgh County official or other authorized individual.

(D)    Penalty and Enforcement.

(1)    If a person violates any provision of this chapter, such person shall be subject to a fine of Five Hundred Dollars ($500.00) per violation.

(2)    If a person violates this chapter and such violation results in physical injury to any person or damage to the property of another person, or of Vanderburgh County, the fine to be issued to such person shall be increased to One Thousand Dollars ($1,000.00) per violation.

(3)    The Vanderburgh County Sheriff’s Office shall enforce this Ordinance and all fines collected by the County for such violations under this chapter shall be deposited in the Vanderburgh County Sheriff’s Office training account for training uses by the County Sheriff’s Office.
