15.32.010 Definitions.

For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.

“Applicant” means the person, partnership, corporation, or other entity making application for a building permit. An applicant must be the owner or the authorized representative of the owner of the real estate for which the permit is requested.

“Building commissioner” means the building commissioner of the city of Evansville-Vanderburgh County.

“Drain” or “watercourse” means a channel, open or closed, through which water is conveyed, whether natural or man-made.

“Flood” or “flooding” means a general and temporary condition of partial or complete inundation of normally dry land areas from the overflow of drains, streams, rivers, watercourses, or other inland water.

“Legal drain” means a drain established by law by the county drainage board in accordance with the terms and provisions of the State Drainage Code, as amended.

“Legal drain maps” means the official maps designated to identify legal drains in the county.

“Mean sea level datum” means the datum plain used by the U.S. Geological Survey for the county quadrangle mapping, 1929 adjustment.

“Platted lot” means a parcel of land (consisting of a full lot or lots or part of a lot or lots) which are included within a plat which plat has been approved by the Evansville-Vanderburgh area plan commission and recorded in the office of the county recorder.

“Sediment” means any matter deposited by water or wind.

“Site” means the real estate set forth in the legal description of the property upon which the improvement for which a building permit is requested is to be constructed.

“Unplatted lots” means parcels or tracts of land which are not included within a plat approved by the Evansville-Vanderburgh area plan commission, which plat is duly recorded in the office of the county recorder.

15.32.020 Drainage and flood restrictions.

A.    If the site for which a building permit is sought is not within the floodplain, no building permit shall be issued unless the first floor of the living space of a residential structure, or the first flood of a commercial or industrial structure, including basement, is constructed above the level of flooding during a one hundred (100) year flood, or the grading at its highest level adjoining the improvements as graded pursuant to Section 15.08.010 is above the level of flooding of a one hundred (100) year flood.

B.    If the site for which a building permit is sought is located in the floodplain, no building permit shall be issued unless the first floor of the living space of a residential structure, or the first floor of a commercial or industrial structure, including the basement, is constructed two feet above the one hundred (100) year flood plain elevation established for the site by the flood plain map. C.    In Zone A, as determined by the FIRM maps, areas below the 100 year flood elevation shall not be enclosed in any manner which would impede the free flow of water (open lattice work or insect screening are permitted). In no case may existing enclosures be finished for occupancy or the open areas be reduced in size or ability to allow free flow of water through them. If the finished grade elevation around the structure is above the 100 year flood elevation, the floor of crawl spaces may be at an elevation below the 100 year flood plain, but may not contain any equipment which could be damaged by flooding. This does not apply to construction which has been built on ground elevated by fill.

15.32.030 Site plan.

Each applicant for a building permit shall submit a site plan to the joint department of building commissioners. A site plan shall consist of two copies each, not less than eight and one-half by eleven (11) inches in size, of a contour map and a drainage map.

A.    Each applicant for a building permit shall submit a site plan to the office of the Building Commissioner. The site plan shall be an accurately scaled drawing containing the following information:

1.    Lot dimensions;

2.    Street right-of-way widths;

3.    Existing easements and widths;

4.    Street pavement widths;

5.    Sidewalk location;

6.    Locate and dimension existing structures on site;

7.    Dimension proposed buildings and/or accessory structures;

8.    Dimensions between buildings and between buildings and property lines;

9.    Size and location of proposed curb cuts and existing curb cuts within fifty (50) feet;

10.    Dimensioned parking for all site plans except single family residence;

11.    List units and bedrooms for apartments, square footage for commercial/ industrial buildings;

12.    Lot number and subdivision or attach a legal description of the parcel;

13.    Street address;

14.    Scale;

15.    North arrow;

16.    Date;

17.    Signature of person certifying plan.

B.    In addition to the information required for the site plan stated above, a site grading plan shall be submitted when any one of the following conditions exist:

1.    Lot is located within seventy-five feet (75’) of a “Regulated Drain”;

2.    Lot is in or partially in the one hundred (100) year flood plain;

3.    Lot is within fifty feet (50’) of a natural drain or watercourse;

4.    Lot is within an area of localized flooding indicated by flood protection grades (FPG) on the subdivision plat or as determined by the Building Commissioner.

C.    The site grading plan shall show the following:

1.    Original ground contours (dashed) at 2.5 foot or closer intervals on and within one hundred feet (100’) of the lot to be built upon.

2.    Final contours (solid) at one foot (1’) intervals on and within fifty feet (50’) of lot to be built upon.

3.    Location, size and invert elevation of drainage structures within one hundred feet (100’) of the site.

4.    Centerline elevation of road and sidewalk elevations adjacent to the lot opposite lot corners and at high or low points.

5.    Present and proposed drainage ditches crossing or adjacent to the site with flow line elevations opposite lot lines including high points of swales between lots and flow direction arrows.

6.    Minimum allowable Flood Protection Grade (FPG) from Flood plain map, Subdivision plat or drainage study.

7.    Proposed grades of lowest floors (includes garages or basements) grades must be based on USGS datum.

8.    The site grading plan must be prepared and certified by a Professional Engineer or Professional Land Surveyor, registered in the State of Indiana.

9.    If a retaining wall over six feet (6’) high will be used - The detail drawings of the wall shall be attached and certified by a Professional Engineer.

15.32.060 Inspection.

The joint department of building commissioners shall keep files of all applications and proceedings pursuant to them, indexed by the location of the site by road name. The department shall be responsible for the enforcement of this chapter. The city engineer or county engineer shall assist the department on technical problems which may arise. The department or its authorized representative shall check each site upon completion of the proposed work. A written record shall be made of the improvements of the site as finally accepted.
