2.15.010 Public parks.

The town of Whitestown shall operate a system of public parks under the jurisdiction of a board of park commissioners. [Ord. 1984-05 § 10. Prior code Title 3, Art. 4, Ch. 1]

2.15.020 Department established.

There is hereby established a department of parks and recreation pursuant to IC 36-10-3-1 et seq. composed of a four-member board of parks and recreation.

A. The president of the town council shall have control of the day-to-day operation of the department of parks and recreation, and shall select the regular members of the board on the basis of their interest in and knowledge of parks and recreation but not more than two members shall be of the same political party.

B. Upon establishment of the board, the terms of the members initially appointed shall be one year, two years, three years, and four years respectively. Thereafter, as a term expires, each newly appointed member shall serve for a term of four years.

1. All terms shall expire on the first Monday of January, but an appointee shall continue his office until his successor is appointed. An appointing authority shall make initial appointments within 90 days after the creation of the department.

2. If an appointment for a new term is not made by the first Monday in April, the incumbent shall serve another term.

3. If a vacancy on the board occurs, the president of the town council shall appoint a person to serve for the remainder of the unexpired term.

C. At the first regular meeting in each year, the board shall elect a president, vice-president, and secretary-treasurer. The vice-president shall have authority to act as president of the board during the absence or disability of the president.

D. The board shall have the power to perform all acts necessary to acquire and develop sites and facilities to conduct such programs as are generally understood to be park and recreation functions pursuant to IC 36-10-3-1 et seq.

E. The board may create an advisory council and special committees as needed to further its stated purpose.

F. The board shall prepare and submit an annual budget in the manner as other departments of town government. The board may accept gifts, grants, donations, and subsidies for park and recreation purposes.

G. The board shall convene its regular public meeting at least quarterly. A majority of the members constitutes a quorum. Action of the board is not official unless it is authorized by at least three members present and acting. [Ord. 2001-21; Ord. 1975-08 §§ 1, 2]
