8.05.010 Fees for false alarms.

Any person, firm, partnership, corporation, or entity having, owning, possessing, leasing, or controlling a fire, burglar, holdup or any type of intrusion alarm (“user”) shall be charged a fee of $25.00 for the second false alarm responded to by the Whitestown police and/or fire department(s) within a 12-month period, a $50.00 fee for the third false alarm responded to by the Whitestown police and/or fire department(s) within a 12-month period, and a $100.00 fee for each subsequent false alarm responded to by the Whitestown police and/or fire department(s) within the same 12-month period, as well as all repeated false alarms during the same 12-month period. There shall be no distinction between fire or police false alarms for purposes of imposing a fee. Any false alarm fee shall be paid in full within 30 days absent an appeal to the Whitestown town court as set forth herein. [Ord. 2010-08 § 1]

8.05.020 False alarm defined.

For purposes of this chapter, a false alarm shall mean an alarm eliciting a police or fire response when the situation does not require police or fire services; provided, however, a false alarm shall not include an alarm for which the user has notified the Whitestown police and fire departments in writing at least 24 hours in advance of an anticipated alarm due to installation or maintenance, as well as provided a verbal notice one hour prior to and immediately upon the conclusion of the anticipated alarm event. 8.05.030 Enforcement authority.

Any member of the Whitestown police and/or fire department who is duly appointed with enforcement authority may issue a false alarm warning and/or a false alarm citation, or exempt a false alarm due to severe atmospheric conditions or other circumstances not reasonably under the control of the alarm user, installer, and maintenance provider. 8.05.040 Appeals.

Any user who has received a warning or citation shall have 30 days from the date of the false alarm to appeal such warning or citation to the Whitestown town court. The Whitestown town court may waive a false alarm fee if, in the court’s discretion, the user establishes that the false alarm was not the result of negligence, an intentional act, or improper maintenance. In the event the Whitestown town court does not waive an appealed false alarm fee, the user shall also be responsible for court costs as directed by the Whitestown town court. [Ord. 2010-08 § 4]
