12.05.010 Need established.

A need now exists for the establishment of an ordinance establishing the authority of the Whitestown metropolitan police and Whitestown fire department officials pertaining to emergency and temporary street closures and restrictions for the following purposes. [Ord. 2012-11]

12.05.020 Police duty.

It shall be the duty of the officers of the Whitestown metropolitan police department, or such officers and persons as are assigned by the chief of police or the board of metropolitan police commissioners, to enforce all provisions of this chapter, or any other ordinances or state laws applicable to traffic or parking within the town of Whitestown. 12.05.030 Authorization.

Officers of the department, or such persons or officers as are so assigned by the board of metropolitan police commissioners or by the chief of police, are authorized to direct and control all traffic by voice, hand, signs or signals in conformity with this chapter or other traffic laws and regulations of the town of Whitestown or state of Indiana. In the event of and during a special event, parade, fire, road repair or any other emergency or nonemergency situation which may arise, to expedite traffic or to safeguard pedestrians or any person or property, any officers of the Whitestown metropolitan police department or any other authorized person may direct, control, divert or exclude traffic, as conditions may then and there require without prior authorization or approval. 12.05.040 Fire department duty.

Officers of the Whitestown fire department, when at the scene of a fire or other occurrence, may direct or assist the Whitestown metropolitan police department in directing or controlling traffic and may limit, divert or exclude traffic at the scene of any fire or emergency situation in the immediate vicinity thereof, while the emergency continues. 12.05.050 Street closures.

Whenever any street, alleyway or public place, or part thereof, is being utilized for any other purpose than normal traffic flow, being repaired, constructed, reconstructed, cleaned, being worked on by the town, contractors or public utilities; or whenever any parade, special event or any other use of any such street or alleyway has been authorized by the town; or whenever any street, alleyway or public place is ordered closed to traffic because of a fire, accident or for any other reason in any emergency or nonemergency situation involving the public safety or welfare; the Whitestown metropolitan chief of police or the Whitestown fire chief is authorized to make and enter special or emergency orders and to post appropriate temporary parking restriction or street closure signs or placards thereon, or to station police or fire officers or other authorized persons thereon, indicating that all vehicles are wholly or partly excluded from parking upon all, or any portion of such street, alleyway or public place, that is so designated, or from remaining there, or from entering same, during any such time period as determined for any of the situations listed in this chapter and until the conditions requiring such restrictions are terminated by their authority. 12.05.060 Enforcement.

Whenever and as long as a notice is so posted, or the driver is so instructed and directed by any officer or other authorized person, no vehicle shall remain or be parked at any such place so prohibited or limited and no vehicle shall enter or remain upon any such street, alleyway or public place where and while so prohibited and restricted. All vehicles already so parked shall be promptly removed by the owner of the vehicle or may be removed by any officer or other authorized person of the Whitestown metropolitan police department by impoundment. Such restrictions may also be applied to persons whenever any other dangerous or harmful conditions render their removal necessary. [Ord. 2012-11]
