12.25.010 Park established.

A. The town of Whitestown, Indiana acting by and through its duly elected board of trustees is hereby authorized and directed to establish, lay out and construct a public park and recreation area either within or without the limits of the town of Whitestown, Indiana.

B. The board of trustees of said town, be and they are hereby authorized to meet and determine what lands are necessary to be acquired for the use of said public park. They are further directed to meet and appraise such lands as may be needed for such park and take such other steps as may be necessary to acquire them. [Ord. 1967-01 §§ 1, 2]

12.25.020 Park rules.

A. Definitions.

1. The term “person” means every natural person, firm, partnership, association or corporation.

2. The term “board” refers to the Whitestown board of parks and recreation.

B. Rules and Regulations.

1. No person shall hunt, trap, snare, injure or kill an animal on park property.

2. No person shall fire or discharge a firearm, including air or spring powered pellet or BB guns on or into park property.

3. No person shall shoot an arrow with a bow or otherwise on or into park property without prior written consent granted by the parks board.

4. No person shall operate any motorized vehicle or off-road vehicle, except town maintenance vehicles, on any park property, excluding parking areas. The riding of nonmotorized personal conveyance, skateboards, bicycles, etc., on any park property shall be at the rider’s own risk and only in designated areas. It shall be unlawful for any person to organize, sanction, hold or engage in any bicycle race or speed contest on park property without prior written consent of the board.

5. No person shall maintain, construct, assemble or store any building, tree house, structure, or personalty on park property.

6. No person shall cut, remove, deface or destroy any tree, shrub, flower, or plant excluding normal and customary maintenance and weed control. This shall not prohibit removal of any plants or vegetation pursuant to any nature or science studies conducted by a school or under the supervision of a teacher or supervisor and then only with prior written consent of the board.

7. Except for grills installed thereon, no person shall cause or cause to be started a fire unless with prior written consent of the board.

8. No person shall be on park property before or after the hours posted thereon. [Ord. 2001-21]
