2.65.01 Housing authority created.

There shall be and hereby is created a housing authority for the city pursuant to the municipal housing law, as amended to be known as the Baxter Springs housing authority. (Ord. 385 § 1. Code 1996 § 8-701)

2.65.02 Composition.

The Baxter Springs housing authority shall consist of five persons as commissioners to be appointed by the mayor with the consent of the governing body. The commissioners who are first appointed pursuant to this act shall be designated to serve: one for one year, one for two years, and one for three years and two for four years each, from the date of their appointment, but thereafter such commissioners shall be appointed as aforesaid for a term of office of four years except that all vacancies shall be filed for the unexpired term, all such appointments to be made by the mayor with the consent of the governing body. 2.65.03 Commissioner.

A commissioner shall receive no compensation for his or her services, but shall be entitled to the necessary expenses, including traveling expenses, incurred in the discharge of his or her duties. Each commissioner shall hold office until his or her successor has been appointed and has qualified. A certificate of the appointment or reappointment of any commissioner shall be filed with the housing authority and this certificate shall be conclusive evidence of the due and proper appointment of the commissioner. 2.65.04 Powers.

The powers delegated by the governing body of the city to the Baxter Springs housing authority, from time to time, shall be by ordinance, and such powers shall vest in the commissioners thereof in office from time to time. Three commissioners shall constitute a quorum of such authority for the purpose of conducting its business and exercising its powers and for all other purposes, notwithstanding the existence of any vacancies. Action may be taken by the authority upon a vote of a majority of the commissioners present, unless in any case the bylaws of the authority shall require a large number. Meetings of the commissioners of an authority may be held anywhere within the perimeter boundaries of the area of operation of the authority or without any additional area where the authority is authorized to undertake a project. Appointments may be made of any persons as commissioners of the authority who reside within its boundaries or area, and who are otherwise eligible for such appointment. The commissioners of the authority shall elect a chairperson and vice-chairperson from among the commissioners. (Ord. 385 § 4. Code 1996 § 8-704)

2.65.05 Misconduct in office.

For inefficiency or neglect of duty or misconduct in office, a commission of the housing authority may be removed by the mayor, but a commissioner shall be removed only after a hearing and after he or she shall have been given a copy of the charges at least 10 days prior to the hearing and had an opportunity to be heard in person or by counsel. In the event of the removal of any commissioner, a record of the proceedings, together with the charges and findings thereon, shall be filed in the office of the city clerk. (Ord. 385 § 5. 2.65.06 Executive director.

The Baxter Springs housing authority shall be, and hereby is, authorized to employ an executive director, technical experts, and such other officers, agents and employees, permanent and temporary, as it may require, and to delegate to one or more of its agents or employees such powers or duties as the authority may deem proper. 2.65.07 Further powers.

The housing authority shall have only such powers as may be delegated to it, from time to time, by this chapter or any ordinance of the governing body of the city and as may be authorized by the municipal housing law of the state of Kansas. (Ord. 385 § 7. Code 1996 § 8-707)
