2.80.01 Incorporating Code of Procedure for Kansas Cities.

There is hereby incorporated by reference for the purpose of establishing a code of procedure for the conduct of city council meetings of the City of Baxter Springs, Kansas, that certain model code known as the “Code of Procedure for Kansas Cities,” First Edition (2004), prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas, except for such articles, sections, parts or portions as are hereafter omitted, deleted, modified or changed. (Ord. 797 § 1)

2.80.02 Official copies.

At least three copies of the Code of Procedure for Kansas Cities shall be marked or stamped “OFFICIAL COPY AS INCORPORATED BY ORDINANCE NO. 797,” with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached a copy of the ordinance codified in this chapter. All official copies shall be filed with the city clerk to be open to inspection by the public during all reasonable business hours. Official copies of the Code of Procedure for Kansas Cities shall be furnished to all persons or departments charged with the enforcement of the code or to whom the code is applicable and to such others as may be deemed necessary. All such copies shall be furnished at the cost of the city. (Ord. 797 § 2)

2.80.03 Omissions and deletions.

Sections 36 and 38 of the Code of Procedure for Kansas Cities relating to an ordinary ordinance by commission city and charter ordinance by commission city are hereby declared to be and are omitted and deleted. (Ord. 797 § 3)

2.80.04 Modifications and changes.

(a) Section 11 of the Code of Procedure for Kansas Cities is hereby changed to read as follows:

Section 11. Additions to Agenda. Items may be added to or removed from the agenda at any time during regular meeting by motion upon approval by majority of the Governing Body members present and voting. No items may be added to the agenda of a special meeting.

(b) Section 12 of the Code of Procedure for Kansas Cities is hereby changed to read as follows:

Section 12. Order of Business. At the hour appointed for the meeting, the Mayor shall call the meeting to order. In council cities, the president of the council shall chair the meeting in the absence of the Mayor. Upon having a quorum present, the Governing Body shall proceed to business, which shall be conducted in the following order:

1. Call to Order; 2. Roll call; 3. Approve the agenda; 4. Approve minutes of the last regular meeting or intervening special meeting; 5. Approve appropriation ordinance; 6. Visitors; 7. Resolution/Ordinances/Attorney Report; 8. Department head reports; 9. Committee Reports; 10. Mayor’s report; 11. Unfinished business; 12. New business; 13. Public comment (limited); and 14. Adjournment.

(c) Section 16 of the Code of Procedure for Kansas Cities is hereby changed to read as follows:

Section 16. Debate. All motions are debatable unless otherwise noted in the section governing that motion, except to call the question.

(d) Section 24 of the Code of Procedure for Kansas Cities is hereby changed to read as follows:

Section 24. Motion to go into executive session. The motion to go into executive session shall be made as follows:

I move that the Governing Body recess into executive session pursuant to one of the following exceptions:

1. Personnel matters of non elected personnel; 2. Attorney/Client privilege; 3. Employer/Employee relations and negotiations; 4. Confidential data relating to financial affairs or trade secrets of second parties; 5. Discussions prior to acquisition of real estate; 6. Discussions concerning security matters; and 7. Matters relating to the security of a public body or agency, public building or facility or the information system of a public body or agency, in order to discuss _______ general description), the open meeting to resume in city council chamber at _______ (time).

The motion may also state who is to be present in the executive session, although this is not required. This motion must be made, seconded and carried. Such motions shall be recorded in minutes of the meeting. The meeting may not reconvene until the time stated in the motion.

(e) Section 27 of the Code of Procedure for Kansas Cities is hereby changed to read as follows:

Section 27. Form of vote. All votes shall be by voice vote as “yes or no.” No votes shall be by secret ballot.
