RESTRICTIONS ON KENNELS AND NUMBER OF ANIMALS IN RESIDENCES

6.25.01 Kennel restrictions.

No person, firm or corporation shall engage in the commercial business of breeding, buying, selling, trading, or boarding of dogs within the limits of the City of Baxter Springs, Kansas. (Ord. 881 § 1)

6.25.02 Number of animals allowed.

No person or household shall own or harbor more than four animals of six months of age or older, or more than one litter of pups until weaned. The four-animal limit is applied to each household/residence, not “per owner” on the property/premises. (Ord. 881 § 2)

6.25.03 Penalty for violations.

Any person violating or permitting the violation of any provision of this chapter shall upon conviction in municipal court be fined a sum not less than $50.00 and not more than $500.00. In addition to the fine imposed, the court may sentence the defendant to imprisonment in the county jail for a period not to exceed 30 days. Should the defendant refuse to remove the animal(s) from the city, the municipal court judge shall find the defendant in contempt and order the immediate confiscation and impoundment of the animal(s). Each day that a violation occurs shall constitute a separate offense and shall be punishable hereunder as a separate violation. In addition to the foregoing penalties, any person who violates this chapter shall pay all expenses, including sums for shelter, food, handling, and veterinary care, which are necessitated by the person’s failure to abide by the provisions of this chapter.
