8.45.010 Policy.

(a) On July 1, 2010, the Legislature of the State of Kansas enacted K.S.A. 21-4010, et seq., prohibiting smoking in enclosed areas that include public and private places and any place of employment.

(b) In order to protect and enhance indoor air quality and to contribute to the health and well-being of the public and its employees, the City of Baxter Springs, Kansas will immediately enact policies and procedures to comply with the effective date of July 1, 2010, and enact policies and procedures to ensure that it is a smoke- and tobacco-free environment effective January 1, 2011.

(c) The use or consumption of all tobacco products is hereby prohibited, including electronic cigarettes (e-cigarettes), in all enclosed buildings, common work areas, conference and meeting rooms, hallways, eating areas, restrooms, and all city owned or leased vehicles and equipment at any time.

(d) The only designated smoking areas or areas for tobacco use are outdoors. No one may smoke, use tobacco or electronic cigarettes along a pathway or walkway leading to or from a designated smoking area, nor may employees smoke, use tobacco or electronic cigarettes at picnic tables or outdoors in any of the grass areas.

(e) Employees and the public may choose to use designated smoking areas at their own risk. No additional breaks are allowed to any employee who smokes, uses tobacco or electronic cigarettes. Smokers, users of tobacco products and electronic cigarettes must dispose of the remains in proper containers to help maintain a neat and clean environment for all employees and the public who visit or use our facilities.

(f) All areas maintained or open to the public that include but are not limited to city parks, city pool, community center and all other buildings or areas open to the public are smoke-free effective July 1, 2010, and shall be smoke-, tobacco-free and electronic-cigarette-free upon passage of the ordinance codified in this section. Penalties for violation of this section shall be in accordance with the Uniform Public Offense Code for Kansas Cities 2010 Edition, Section 10.26(d), and as amended. (Ord. 917 §§ 1 – 5, 7)
