18.70.01 Enforcement.

The building inspector or designated official of the mayor shall have the power and duty to enforce the provisions of this title. An appeal from a ruling of the building inspector shall be made to the zoning board. (Code 1996 § 16-284)

18.70.02 Form of petitions, applications and appeals.

All petitions, applications and appeals provided for in this title shall be made on forms provided for the purpose or as otherwise prescribed by the administrator (building inspector) in order to assure the fullest practical presentation of pertinent facts and to maintain a permanent record. All applications for building and occupancy permits shall be accompanied by plans and specifications, drawn to scale, showing the actual shape and dimensions of the lot to be used and or built upon; the exact sizes and locations on the lot of the buildings and other structures, existing and proposed; the existing and intended use of each building, structure, or part thereof; the number of families to be accommodated if any; and such other information as is needed to determine conformance with the provisions of this title and of the building code. 18.70.03 Temporary permits.

The building inspector shall issue temporary permits for buildings to be constructed and used for storage incidental to construction of buildings on the property and for signs advertising a subdivision or tract of land or the lots thereon. (Code 1996 § 16-286)

18.70.04 Time limit on permit for a conditional use or a variance.

A building permit for a conditional use or for a use involving a variance shall be void after six months if no substantial construction has taken place. (Code 1996 § 16-287)

18.70.05 Interpretation.

The provisions of this title shall be held to be the minimum requirements fulfilling its objectives. Where the conditions imposed by any provision of this title are less restrictive than comparable conditions imposed by any other provision of this title or of any other article, the provisions which are more restrictive shall govern. (Code 1996 § 16-288)

18.70.06 Severability.

The provisions of this title are hereby declared to be severable. If any section, sentence, clause or phrase of this title is adjudged by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this title. (Code 1996 § 16-289)

18.70.07 Penalty.

The owner or owners of any building or buildings or premises or part thereof where any violation of this title exists or is placed or maintained and any architect, builder or contractor who assists in the commission of any such violation, and all persons or corporations, including, but not limited to, tenants and users of the subject premises, who violate or maintain any violation of any of the provisions of this title or who fail to comply therewith or with any requirements thereof or who build in violation of any statement of the plan submitted and approved thereunder shall, for each and every violation or noncompliance, be guilty of a misdemeanor and, upon conviction hereof, shall be subject to a fine of not less than $50.00 nor more than $2,500, or incarceration not to exceed 30 days, or both such fine or imprisonment for each offense. Every person or corporation violating or contributing in any way to the violation of any provision of this title shall be deemed guilty of a separate offense of each day during which such violation continues and may be punished therefor as herein provided.
