ARTICLE 2. PUBLIC BUILDING COMMISSION

12-201. BUILDING COMMISSION CREATED.

There is hereby created the Nickerson Public Building Commission pursuant to the provisions of K.S.A. Supp. 12-1757 to 12-1768, inclusive, as the same now exists or as the same may be amended in the future. Such Nickerson Public Building Commission shall be a municipal corporation and shall have all the power and authority as set out in the statute.

12-202. MEMBERSHIP.

The Nickerson Public Building Commission shall be composed of either members, who shall be the same persons as the mayor, the members of the council and the city clerk of the city. The term of office of the members of the Nickerson Public Building Commission shall coincide with their terms of office as mayor and members of the council and the term of office of the city clerk as a member of the Nickerson Public Building Commission shall coincide with the term of the mayor. The mayor shall appoint the members of the Nickerson Public Building Commission as aforesaid. In the event any person so appointed shall decline to serve as a member of the Nickerson Public Building Commission, then the mayor shall, with the approval of the council, appoint a person from the citizens of the city at large to serve as a member of the Nickerson Public Building Commission for a term which shall be the same as the person so replaced.

12-203. POWERS AND FUNCTIONS.

The Nickerson Public Building Commission is created for the following purposes and shall exercise the following powers and functions:

(a)    To acquire a site, construct, equip and furnish a building or buildings, or to purchase or otherwise acquire a building or buildings or other facilities for federal, state or county governmental agencies or for any municipal corporation, a quasi-municipal corporation, political subdivision or body politic or agency thereof;

(b)    To rent all or any part of the building to any federal, state or county governmental agency or to any municipal corporation, quasi-municipal corporation, political subdivision or body politic or agency thereof, and further to rent any space as may not be needed by such governmental agencies as provided by law.

(c)    To acquire fee simple title to real estate, including easements and reversionary interests in streets, alleys and other public places and personal property required for its purposes, by purchase, gift, devise or by the exercise of the power of eminent domain and to take title in the corporate name of the commission;

(d)    To borrow money and issue revenue bonds in the manner provided by law for the purpose of paying the cost of a portion of the cost of acquiring real estate and construction, equipping and furnishing buildings thereon and to pledge the net revenues from the facilities to secure such revenue bonds and to make covenants with respect to the maintenance, operations, repair and insuring of improvements thereon;

(e)    To sue and be sued;

(f)    To adopt a seal;

(g)    To convey title to the city or any other political subdivision for whose benefit the Nickerson Public Building Commission has held title after the payment of revenue bonds issued for the purpose of acquiring a site or constructing buildings thereon for the benefit of any sub-political subdivision. Conveyance may be made of portion of the land as portions of the revenue bonds are paid or retired or provisions is made for their payment by the deposit of a like amount of money;

(h)    To do all things and acts necessary or convenient to carry out the powers granted to it under this section and under K.S.A. Supp. 12-1757, et seq., provided, however, that under no circumstances shall any income of the Nickerson Public Building Commission inure to the benefit of any private person.

12-204. BUILDING ACQUISITION.

Subject to the provisions hereof, the Nickerson Public Building Commission shall provide for the acquisition and equipping of a building, shall prepare all leases required in connection therewith an arrange for all financing of the building, including the equipping and all rentals, payments and revenue bond debt service requirements.
