ARTICLE 4. CITY CEMETERY

12-401. HOURS OF USE.

It shall be unlawful to enter or be within the limits of the Nickerson cemetery, or to remain therein, except during daylight hours.

12-402. DEFINITIONS OF DAYLIGHT HOURS.

Daylight hours shall mean that period of time when any portion of the sun is visible, or would be visible if not obscured by clouds. (Code 1987, 18-202)

12-403. PLACING OF MONUMENTS.

(a)    Permit Required. No monument shall be placed in Wildmead Cemetery without first obtaining a permit from the city clerk and paying a permit fee of $35.00.

(b)    Placing of Monuments. All monuments placed within Wildmead Cemetery shall be placed only on cemetery lots owned by the individual requesting placement, or by members of his or her immediate family; and then only at the head of the lot.

(c)    Unlawfully Placed Monument. If a monument is improperly placed, the city will give the responsible parties a 30-day notice by first class mail, postage prepaid, to move the monument. If the monument has not been moved within that period of time, the city may, at its option, move the monument and the responsible party shall become liable for the costs of the move.
