(A) The City Engineer may grant a deviation from the erosion and sediment control standards, provided all of the following conditions are met:

(1) The deviation complies with the general spirit and intent of the erosion and sediment control standards.

(2) The granting of the deviation will not adversely affect the rights of adjacent landowners.

(3) The granting of the deviation will not result in substantial public expense, create nuisances, cause fraud on or cause harm to the public or conflict with existing local, federal or State laws, rules or regulations.

(4) The deviation will not adversely affect the public health, safety, morals, order, convenience, prosperity or general welfare.

(B) Appeals of decisions made by the City Engineer related to erosion and sediment control standards must be made to the City Manager within ten (10) calendar days of the date of notice of such decision. The City Manager’s decision is a final decision of the City. (Ord. 22-52 § 19, 2022; Ord. 09-25 § 2, 2009.)
