ARTICLE 4. ANIMALS AND MOTORIZED VEHICLES ON SIDEWALKS AND TRAILS

11-401. ANIMALS AND MOTORIZED VEHICLES ON SIDEWALKS AND TRAILS PROHIBITED.

(a)    Except as provided in subsection (c) of this section it shall be unlawful for any person to have any animal, except a properly restrained or leashed dog or cat, on the city’s sidewalks and trails.

(b)    Except as provided in subsection (c) of this section it shall be unlawful for any person to have or operate any motorized vehicles on the city’s sidewalks and trails.

(c)    Notwithstanding the provisions of subsections (a) and (b) of this section, motorized vehicles operated by the city of Tonganoxie, Leavenworth County or the State of Kansas, or motorized vehicles owned and operated by persons contracted with the city, county or state, or any motorized wheelchair or electric scooter for the use of a person with a disability may be used and operated on the city’s sidewalks. Any vehicle meeting the exception of this subsection shall not exceed five miles per hour.

(d)     A violation of this section shall be considered a traffic infraction subject to a fine not to exceed $500. Upon a violation of this section a police officer may issue a citation with a notice to appear in the municipal court of Tonganoxie to answer the charge.
