ARTICLE IX. NON-STORMWATER DISCHARGES

58-700 Definitions.

For the purposes of this article, the words set out shall have the following meanings:

Discharge means the addition of any waste, waste effluent, wastewater, pollutant, or any combination thereof to any surface water of the State.

Municipal separate storm sewer system (MS4) means all separate storm sewers that are owned or operated by the United States, a state, city, township, county, district, association, or other public body created by or pursuant to State law, having jurisdiction over disposal of sewage, industrial wastes, stormwater, or other wastes, including special districts under State law, such as a sewer district, flood control district, or drainage district, or similar entity, or a designated or approved management agency under Section 208 of the Clean Water Act that discharges to the waters of the State. This term includes systems similar to separate storm sewer systems in municipalities, such as systems at military bases, large hospital or prison complexes, and highways and thoroughfares. The term does not include separate storm sewers in very discrete areas, such as individual buildings.

NPDES means National Pollutant Discharge Elimination System.

Stormwater means stormwater runoff, snow melt runoff, surface runoff and drainage, and nonstormwater included under the conditions of this article.

Waters of the State means any of the following: groundwater; lakes, including the Great Lakes bordering the State; rivers; streams; all other water courses and bodies of water within the jurisdiction of the State, including wetlands as defined by Part 303 of the Act, wetlands protection, being SS324.30301 to 324.30323 of the Michigan Compiled Laws.

58-701 Unauthorized discharges.

(a)    No person shall discharge or cause to be discharged into the MS4 or waters of the State any materials, including but not limited to pollutants or waters containing any pollutants that cause or contribute to a violation of applicable water quality standards, other than stormwater. The commencement, conduct, or continuance of any illicit discharge to the MS4 is prohibited; however, the following discharges are excluded from prohibition as described so long as they are identified as not being a significant contributor of pollutants to the waters of the State:

(1)    Water line flushing and discharges from potable water sources;

(2)    Landscape irrigation runoff, lawn watering runoff, and irrigation waters;

(3)    Diverted stream flows and flows from riparian habitats or wetlands;

(4)    Rising groundwaters and springs;

(5)    Uncontaminated groundwater infiltration and seepage;

(6)    Uncontaminated pumped groundwater, except for groundwater cleanups specifically authorized by NPDES permits;

(7)    Foundation drains, water from crawl space pumps, footing drains, and basement sumps;

(8)    Air conditioning condensation;

(9)    Waters from noncommercial car washing;

(10)    Street wash water; and

(11)    Dechlorinated swimming pool water from single-, two- and three-family residences.

(b)    Discharges or flows from firefighting activities are not prohibited unless they are identified as a significant source of pollutants to the waters of the State.

58-702 Prohibition of illicit connections.

(a)    The construction, use, maintenance, or continued existence of illicit connections to the storm drain system is prohibited.

(b)    This prohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices applicable or prevailing at the time of connection.

(c)    A person is considered to be in violation of this article if the person connects a line conveying sewage to a storm drain system or MS4 or allows such a connection to continue.

58-703 Prohibition of direct dumping or disposal of materials into the MS4.

The direct dumping of materials or discharges into the MS4 is prohibited except for those illicit discharges identified as not being a significant contributor to violations of water quality standards.

58-704 Right of entry.

The City of Pontiac Department of Public Works or other authorized enforcement agency shall be permitted to enter upon all properties for the purposes of inspection, observation, measurement, sampling and testing of suspected non-stormwater discharges in accordance with the provisions of this article. Refusal of reasonable access to the City and/or representatives of the authorized enforcement agency to any part of the premises is a violation of this article.
