ARTICLE II. STATE CONSTRUCTION CODE1

8-19. Agency designated.

Pursuant to the provisions of the State Construction Code, in accordance with Section 8b(6) of Act 230, of the Public Acts of 1972, as amended, the Port Huron Township chief building official, as appointed by the charter township of Port Huron, Michigan, is hereby designated as the enforcing agency (person) to discharge the responsibilities of the charter township of Port Huron, under Act 230, of the Public Acts of 1972, as amended, State of Michigan. The charter township of Port Huron assumes responsibility for the administration and enforcement of said Act throughout the corporate limits of the community adopting this article.

8-20 Code appendix enforced.

Pursuant to the provisions of the State Construction Code, in accordance with Section 8b(6) of Act 230, of the Public Acts of 1972, as amended, Appendix G of the Michigan Building Code shall be enforced by the enforcing agency within the jurisdiction of the community adopting this article.

8-21 Designation of regulated flood prone hazard areas.

The Federal Emergency Management Agency (FEMA) flood insurance study (FIS) Entitled "Flood Insurance Study for St. Clair County, Michigan, (all jurisdictions)" and dated July 19, 2022, and the flood insurance rate map(s) (FIRMS) panel number(s) of 26147C0219D, 26147C0238D, 26147C0335D, 26147C0345D, 26147C0352D, 26147C0355D, 26147C0365D, effective May 3, 2010, and 26147CIND0B, 26147C0239E, effective July 19, 2022, are adopted by reference for the purposes of administration of the Michigan Construction Code, and declared to be a part of Section 1612.3 of the Michigan Building Code, and to provide the content of the "Flood Hazards" section of Table R301.2(1) of the Michigan Residential Code.

8-22 Enforcement, administration and fees.

Pursuant to the township electing to enforce, within the township, the State Construction Codes, regulations and rules, as provided by the Stille-DeRossett-Hale Single State Construction Code Act, Public Act No. 230 of 1972 (MCL 125.1501 et seq.), which are incorporated herein by reference, fee schedules for the inspections shall be adopted by resolution of the township board and amended, as necessary, from time to time. The building, electrical, plumbing and mechanical inspectors, or any other official or agent of the township registered under the Building Officials and Inspectors Registration Act, Public Act No. 54 of 1986 (MCL 338.2301 et seq.), qualified by experience or training to perform the duties associated with construction code administration and enforcement, are hereby designated as the enforcing agency, each for his respective code, to discharge the responsibilities of the township for the enforcement and administration of the state construction codes. This designation of an enforcing agency for the administration and enforcement of the state codes does not preclude the enforcement of violations of this article and the state codes by any other authorized township official.
