ARTICLE VIII. DISORDERLY CONDUCT

24-280 Title.

This article shall be known and cited as the "charter township of Port Huron disorderly conduct ordinance."

24-281 Purpose.

This article is enacted for the purpose of protecting public health, safety and general welfare of persons and property within Port Huron charter township, pursuant to the authority granted to townships in the Township Ordinances Act, Public Act 246 of 1945 (MCL 41.181 et seq.), by prohibiting disorderly conduct.

24-282 Regulation.

It shall be unlawful for any person to:

(1)    Engage in any disturbance, fight or quarrel in a public place.

(2)    Be intoxicated in any public place or under the influence of any narcotic drug in any public place endangering directly the safety of another person or property or acting in a manner that causes a public disturbance.

(3)    Engage in any indecent, insulting, immoral, or obscene conduct in any public place.

(4)    Insult, accost, molest, or otherwise annoy, either by word of mouth, sign or motion, any person in any public place.

(5)    Collect or stand in crowds, or arrange, encourage, or abet the collection of persons in crowds for unlawful mischievous purposes in any public place to the annoyance or inconvenience of others.

(6)    Jostle or roughly crowd persons in any street, alley, park or public building.

(7)    Loiter on any street or sidewalk or in any park or public building or conduct himself/herself in any public place so as to obstruct the free and uninterrupted passage of the public.

(8)    Willfully destroy, remove, damage, alter or in any manner deface any property not his/her own.

(9)    Beg in any public place.

(10)    Engage in peeping in the windows of any inhabited place.

(11)    Swim or bathe in any public place in the nude.

(12)    Make any immoral exhibition or indecent exposure of his/her person.

(13)    Engage in any act of prostitution or gross indecency.

(14)    Solicit or accost any person for the purpose of inducing the commission of any illegal or immoral act.

(15)    Attend, frequent, operate or be an occupant or inmate of any place where prostitution, gambling, the illegal sale of intoxicating liquor or narcotics, or where any other illegal business or occupation is permitted or conducted.

(16)    Disturb the peace by loud, boisterous or vulgar conduct.

(17)    Permit or suffer any place occupied or controlled by him/her to be a resort of noisy, boisterous, or disorderly persons.

(18)    Trespass or unlawfully remain upon the premises of another to the annoyance or disturbance of the lawful occupant or agent.

(19)    Prowl about on the private premises of any other person in the nighttime, without authority or the permission of the owner of such premises.

(20)    Throw or propel any snowball, missile or object from any moving automobile.

(21)    Wrongfully throw or propel any snowball, missile or object toward any person or automobile.

24-283 Penalties.

Any violation of this article shall be punishable by a fine not to exceed $500.00 and/or by imprisonment in the county jail for not to exceed 90 days, or by both such fine and imprisonment. Each day that a violation continues to exist shall constitute a separate offense.

In addition, as an alternate remedy, the township shall have the authority to proceed in any court of competent jurisdiction to obtain an injunction, restraining order, or other appropriate remedy to compel compliance with this article. Election of one of the foregoing remedies shall not preclude the application of the other remedy.
