ARTICLE III. NONFERROUS SCRAP METAL YARDS

32-44. Definition.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Nonferrous scrap metal yard means any person, corporation or members of a copartnership or firm whose business is that of purchasing, selling, exchanging, storing or receiving articles of a nonferrous metal.

32-45. Regulations.

(a) Hours of operation.

(1)    Open to public. No scrap metal yard handling nonferrous materials shall be open to the public for transaction of business before the hour of 7:00 a.m. or remain open later than 9:00 p.m. It shall be closed all day Sunday.

(2)    Burning and metal reduction. All burning, smelting, rendering or reducing by heat shall be commenced between the hours of 6:00 a.m. and 9:00 a.m. on Tuesdays through Friday and shall be done in compliance with fire and health regulations.

(b) Purchase restrictions. No applicant licensed under the provisions of this article shall purchase anything whatsoever from:

(1)    Any person who is at the time intoxicated;

(2)    A habitual drunkard;

(3)    Any person known to him to be a thief or an associate of thieves or a receiver of stolen property; or

(4)    Any minor under the age of 17 years or from any person he has reason to suspect of being such.

(c) Appearance. Every applicant licensed under the provisions of this article shall keep and maintain said scrap metal yard in a reasonably neat, orderly and compact arrangement with all of the operations of the scrap metal yard confined to the interior of a building out of sight of the public.

(d) Reports or statements. Every applicant licensed under the provisions of this article shall comply with all requirements with respect to reports or statements required by statute or local resolution governing the conduct of said yard or business.
