ARTICLE II. BOAT CONTROL ON THE BLACK RIVER

38-19. Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Wake means waves of sufficient height so as to endanger other boats or the launching or removal of boats.

Water skiing means surfboards, water skis pulled behind any powerboat, or a single water ski so pulled.

Waterway means the Black River where it is adjacent to township.

38-20. Compliance with state and federal laws.

(a) Properly licensed. No person shall operate a boat unless properly licensed as required by applicable state and federal laws and regulations.

(b) Compliance with regulations. No person shall operate a boat in a manner which does not meet all regulations of the federal government and the state.

38-21. Prohibitions.

(a) Near township boat launching site.

(1)    Water skiing. No person shall water ski on the Black River for a distance of 500 feet below and 500 above the township park boat launching site. However, it shall not be considered to be a violation of this article if persons commence water skiing in the above-named area or cease to water ski in the area so long as such persons do not water ski past the aforementioned area.

(2)    Boat wake. No person shall operate a powerboat in such a manner or at such a speed that the wake from their boat shall endanger persons or boats being launched or being removed from the water at the township boat launching site.

(b) Slow, no wake speed areas.

(1)    R 281.774.4. Near Interstate Bridge. On the waters of the Black River, commencing at a point 600 feet southeast of the Interstate Highway 94 bridge to a point 800 feet northwest of the bridge, sections 3 and 4, T 6 N, R 17 E, Township of Port Huron, County of St. Clair, State of Michigan, no operator of any motorboat shall exceed a slow–no wake speed, which means a very slow speed whereby the wake or wash created by the motorboat would be minimal.

(2)    R 281.774.5. Near Black River and Canal Intersection. On the waters of the Black River, commencing at a point 1,000 feet south of the intersection of the Black River and the Black River Canal, to a point 500 feet northwest of said intersection, section 27, T 7 N, R 17 E, Township of Port Huron, County of St. Clair, State of Michigan, no operator of any motorboat shall exceed a slow–no wake speed, which means a very slow speed whereby the wake or wash created by the motorboat would be minimal.

(c) Garbage disposal. No person in charge of or occupying a boat shall dump or throw garbage, paper, bottles, cans, refuse or debris into the Black River where the Black River is adjacent to and abuts the township.
