12.04.010 Street names to match official map.

The several streets, avenues, alleys and public places and extensions of the same in the town shall hereafter be known and designated by the name applied thereto respectively on the maps and plats of the town and additions filed in the office of the town clerk of the town and the county clerk and recorder of the county. 12.04.020 Incumbering or obstructing street--Permit required.

No person, association, company or corporation shall encumber or obstruct or cause to be encumbered or obstructed, any street, avenue, alley or other public place in the town by placing therein or thereon any building materials, trash, garbage, rubbish, debris, or any article or thing whatsoever, without first having obtained permission in writing from the town council of the town. 12.04.030 Removal of litter.

The town council is authorized to order any article or thing whatsoever, which encumbers, litters or obstructs any street, avenue, alley or public place within the town, to be removed. If such removal shall not be made within six hours after notice to the owner or person in charge thereof to remove the same, or if the owner cannot be readily found for the purpose of such notice, the town council shall cause the same to be removed to some suitable place to be designated by the council, at the expense of the person, corporation or association responsible therefor, and under the pains and penalties as hereinafter provided for violations of this chapter. 12.04.040 Structures in streets--Permit required.

No building or other structure, in whole or in part, shall be erected or placed upon any street, avenue, alley or public place within the town without permission in writing of the town council first had and obtained. (Ord. 27 (part), 1967)

12.04.050 Removal of obstructions--Time allowed-Council action--Interfering with removal.

Any building, fence, porch, steps, gallery, or other obstruction now upon or hereinafter placed or erected upon any street, avenue, alley or public place within the town, or which may be upon any new street, avenue, alley or public place, which may hereafter be opened or created within the town, shall be removed therefrom within such reasonable time, not exceeding thirty days, and not less than three days after notice in writing has been given to the owner or person responsible for such obstruction shall be given by the town council, and if the owner or person responsible for such obstruction cannot be readily found for the purpose of such notice, it shall be the duty of the town council to cause such obstruction to be removed in its discretion and the expense of such removal shall be recoverable from the owner or person responsible for such obstruction, in addition to the penalties provided in this chapter; and every person who shall interfere with, resist or obstruct by acts or threats, or in any other manner, the removal of such obstruction under the order or direction of the town council, shall be deemed guilty of a violation of this chapter. 12.04.060 Obstructions--Warning signals required.

When permission shall have been granted, as provided in this chapter, for the use of any portion of a street, avenue, alley or public place of the town, for any purpose whatsoever, the permittee shall cause torches, or red lights, to be set in such number and location in and about the street, avenue, alley or public place, as will serve to and give reasonable, proper and timely warning of danger or hazard to all persons lawfully using such street, avenue, alley or public place, or any part thereof and shall take all other reasonably necessary precautions to prevent accidents to the public. Such lights and protection shall be maintained between dusk and dawn for each and every day the street, avenue, alley or public place shall be rendered hazardous or unsafe for usual and customary use. Failure or omissions to protect against accident, as in this section provided, shall forthwith work a forfeiture of any permit which may have been granted with preference thereto. 12.04.070 Violations--Penalty.

Violation of this chapter is a municipal infraction subject to the provisions of Sections 7-1-4150 through 7-1-4152, MCA. (Ord. 207 §§26, 48, 2000)

12.04.080 Assignment of street numbers.

The town’s building official, or other employee designated by resolution of the town council, shall assign a street number or address to every residence, business, non-profit organization and governmental facility located within the town. Building owners may continue to employ the street number or address in use on the effective date of this ordinance, unless otherwise notified in writing by the building official. 12.04.090 Responsibility of owner.

It is the responsibility of every building owner to conspicuously affix the street number or address on every building containing a residence, business, non-profit organization or governmental facility. If no street number or address has been assigned, then it is the responsibility of the building owner to obtain a street number or address from the building official. It is also the responsibility of the building owner to affix a street number or address in the manner provided by this chapter within thirty days after a newly constructed building has received a certificate of occupancy or within thirty days after a written notice to affix a street number or address is mailed to or personally served upon the owner by the building official.

12.04.100 Style and location of street numbers.

All street numbers or addresses shall be distinctly legible and at least three inches in height. Street numbers or addresses shall be affixed in a conspicuous place where the number can easily be seen from the street, unless the location of a residence, business, non-profit organization or governmental facility is located within a building so that the street number or address cannot be placed in accordance with this section.
