9.35.010 Failure to report treatment of wounds.

It is unlawful for any physician, surgeon or other practitioner of the healing arts licensed by the state of New Mexico to fail to immediately report to the municipal police department his/her treatment of any person in the municipality for a wound inflicted by a deadly weapon of any kind.

Whoever commits failure to report treatment of wounds is guilty of a petty misdemeanor. [Amended during 2014 codification; Ord. 241 § 2-1-21, 2007].

9.35.020 Fraud.

A. Fraud consists of the intentional misappropriation or taking of anything of value which belongs to another by means of fraudulent conduct, practices or representations.

B. Whoever commits fraud when the value of the property misappropriated or taken is $250.00 or less is guilty of a petty misdemeanor.

C. Whoever commits fraud when the value of the property stolen is over $250.00 shall be referred to a court of higher jurisdiction. [Ord. 241 § 3-1-6, 2007].

9.35.030 Embezzlement.

A. Embezzlement consists of the embezzling or converting to his/her own use of anything of value, with which he/she has been entrusted, with fraudulent intent to deprive the owner thereof. Each separate incident of embezzlement or conversion constitutes a separate and distinct offense.

B. Whoever commits embezzlement when the value of the property misappropriated or taken is $250.00 or less is guilty of a petty misdemeanor.

C. Whoever commits embezzlement when the value of the property stolen is over $250.00 shall be referred to a court of higher jurisdiction. [Amended during 2014 codification; Ord. 241 § 3-1-7, 2007].
