15.20.010 Ownership of bar ditches.

It is hereby stated that the bar ditches in the Village of Cimarron are the property of the said Village of Cimarron. [Ord. 91 § 1, 1970].

15.20.020 Obstruction.

It shall be illegal for any person or persons to obstruct these bar ditches in any way. [Ord. 91 § 2, 1970].

15.20.030 Bridges and culverts – Installation.

If any person or persons wish to install a bridge or culvert in said bar ditches, permission must be granted by the mayor of the Village of Cimarron. [Ord. 91 § 3, 1970].

15.20.040 Bridges and culverts – Regulations.

Any culvert to be installed must be no less than 18 inches in diameter, or a total of 260 square inches opening at no point less than 12 inches wide or high.

Upon the certification of a civil engineer competent in the field of hydrology and registered in the state of New Mexico as to the adequacy of any proposed culvert to carry the storm runoff and drainage from a rainstorm of appropriate puration of an average return frequency of 25 years, the culvert minimum diameter may be reduced to a minimum of 12 inches. For culverts and bridges of other than circular section, for maintenance purposes, at no point shall the minimum clearance be less than 12 inches. [Ord. 103 § 1, 1976; Ord. 91 § 4, 1970].

15.20.050 Violation – Penalty.

Violation of this chapter shall be considered a misdemeanor and shall be subject to penalty as such. [Ord. 91 § 5, 1970].
