ENFORCEMENT AND PENALTIES

17.80.010 Responsibilities for enforcement.

A. The following shall enforce the provisions of this title:

1. All officials charged with issuance of licenses and permits;

2. The regional planning director and/or his/her designee; and/or

3. All officials possessing citation powers applicable to the enforcement of land development regulations.

B. Enforcement Procedures. The following procedures shall apply to enforce the provisions of this title:

1. Order to Comply. In the event of a violation of this title, any of the persons listed in this section may deliver to the person or persons or business organization in violation of this title an order to comply with the provisions of this title within twenty days of receipt of the order to comply;

2. Immediate Threat. In the event of a violation of this title that is deemed by the regional planning director to be an immediate threat to the health, safety or welfare of the public, any of those people responsible for enforcement shall deliver to the persons or person or business organization in violation of this title an order to comply which may provide for complete or partial cessation of activities that create the immediate threat to the health, safety or welfare of the public;

3. Hearing. In the event that a person or persons or business organization does not comply with subsection (B)(1) or (B)(2) of this section, then a notice to show cause may be sent by registered mail to the last known address of the person or persons or business organization that controls the property. A hearing will be set before the regional planning commission to show cause why a criminal citation should not be issued. If the matter cannot be resolved before the regional planning commission then a recommendation can be made to have a citation issued. However, this section does not limit the ability of any of those responsible for enforcement of this title from issuing a citation before going through an administrative hearing with the regional planning commission.

4. Failure to Comply. Upon failure of any person to comply with the provisions of this title, a person responsible for enforcement may issue to the person a criminal citation. (Ord. 11-15-93, 1993; Ord. l -5-87A § 37(A))

17.80.020 Public nuisance.

Any building or structure erected or maintained for any use of property contrary to the provisions of this title is unlawful and a public nuisance. (Ord. 1-5-87A § 37(B))

17.80.030 Penalties.

A. Any person, whether acting as principal, agent, employee or in any other capacity, who violates any of the provisions of this title, is guilty of a misdemeanor and shall be punished by a fine of not more than three hundred dollars, or by imprisonment in jail for not more than six months, or by both such fine and imprisonment.

B. Any person is guilty of a separate offense for each day during which any such violation is committed, permitted or continued by such person.

C. Conviction and punishment of a person shall not relieve the person from the responsibilities of correcting prohibited conditions or removing prohibited buildings, structures or improvements, or prevent the correction or removal thereof. (Ord. 1-5-87A § 37(C))
