6.16.010 Unbranded horse--Capture application.

Any person desiring to capture any unbranded horses running at large within the county must file a written application describing the boundaries within which the capture efforts shall take place. (Ord. 105 § 1, 1987)

6.16.020 Permit application contents.

The application shall include the name, address and telephone number of the applicant, and the reasons by which he claims ownership of the horses, the application shall include written permission of the property owners or their representatives of the property upon which the applicant desires to conduct his capture efforts. The application shall include an agreement to comply with all state laws and regulations governing the management of estrays, and wild horses, and treatment of animals, and the date of proposed roundup. Changes in roundup dates within the permit period must be relayed to the county clerk upon twenty-four hours advance notice. (Ord. 113 (part), 1988: Ord. 105 § 2, 1987)

6.16.030 Permit fee.

The board of county commissioners may require a permit fee to be uniform and as may be established and revised from time to time by resolution. (Ord. 105 § 3, 1987)

6.16.040 Posting of application.

Upon filing of an application with the county clerk, notice thereof, describing the boundaries in which the proposed horse-gathering operation shall take place shall be posted at the Storey County courthouse and the United States Post Office at Virginia City, together with a hearing date before the county commissioners. Notice shall be published at least one time in a newspaper having general circulation within Storey County. The costs of publication shall be paid by the applicant. A copy of the notice shall also be sent, return receipt requested, to the Nevada State Department of Agriculture and to the Commission for the Preservation of Wild Horses. Notice as provided herein shall be given at least ten days before the hearing. (Ord. 105 § 4, 1987)

6.16.050 Capture requirements.

At a hearing thereof, the county commissioners shall impose such conditions on the horse-capturing effort that the circumstances may warrant not in conflict with applicable state laws or county ordinances. These conditions shall include adequate advance notice to interested parties who may desire to observe the horse-gathering operation. The use of aircraft or motor vehicles shall be prohibited. Permits shall be valid for a period of sixty days, following which a new application must be made pursuant to this chapter for additional permits. 6.16.055 Amends NRS 569.050 and 569.080 regarding notice of capture and adoption.

A.    NRS 569.050 is amended to provide that any person intending to take up estrays give ten days’ notice to the property owner where the capture is to take place and notice to the county commissioners of the county where such gathering is to take place, such notice to include the location and date of the proposed gathering.

B.    NRS 569.080 is amended to allow the Department of Agriculture to put unclaimed estrays up for adoption and to establish an adoption fee therefor. (Res. 91-3, 1991)

6.16.060 Cruelty to animals prohibited.

Horse-capturing efforts shall be in compliance with any laws or regulations adopted by the state of Nevada or the county of Storey. Any person who wilfully harasses, wounds, maims or kills any horse within Storey County, or pollutes or causes pollution of any watering hole or spring within Storey County, or uses aircraft or motor vehicles for the purpose of capturing, wounding, maiming or killing any unbranded horse running at large, shall be guilty of cruelty to animals and punishable as a misdemeanor, pursuant to the provisions of NRS 244.359(d). 6.16.070 List of captured horses.

Within thirty days from the termination of the horse-capturing effort, the applicant shall file with the clerk a list of the number of unbranded horses captured, and a justification of claimed ownership. (Ord. 105 § 7, 1987)

6.16.080 Violation--Penalty.

Failure to comply with the provisions of this chapter shall constitute a misdemeanor for each day that horse-gathering efforts are conducted in violation thereof. (Ord. 105 § 8, 1987)
