CONSTRUCTION OF MUNICIPAL INFRASTRUCTURE MANDATORY

13.35.010 Construction outside water service area.

No permit shall be granted for construction of any structure outside of the water service area unless as a condition thereof the applicant, at the applicant’s own expense, extends the water service area to include the lands upon which that structure is to be built. [Ord. 785 § 1, 2006]

13.35.020 Construction outside sewer service area.

No permit shall be granted for construction of any structure outside of the sewer service area unless as a condition thereof the applicant, at the applicant’s own expense, extends the sewer service area to include the lands upon which that structure is to be built. [Ord. 785 § 1, 2006]

13.35.030 Construction on lands not reachable on public street.

No permit shall be granted for construction of any structure on lands not reachable on a public street unless as a condition thereof the applicant, at the applicant’s own expense, builds a paved street upon a route approved by the planning commission connecting those lands into the city’s system of public streets. 13.35.040 Standards.

All infrastructure shall be constructed to currently applicable city standards and donated and deeded upon completion to the city of Burns. In the event of any ambiguity as to the status of currently applicable city standards, the written determination of the city manager shall be final and binding. [Ord. 785 § 1, 2006]

13.35.050 Definitions.

In this chapter the following terms bear the meaning ascribed to each. Terms not defined hereinbelow bear the meanings ascribed to each in Section 2.9 of the city of Burns zoning ordinance.

“Infrastructure” means sewers, water service, and public streets.

“Paved street” means a street or road; as defined in ORS 92.010(13); with asphalt or concrete pavement, concrete sidewalks on each side, curbs, and gutters; and with an improved street width of not less than 36 feet between the curb faces and at least a 50-foot right-of-way.

“Sewer service area” means the sewer service area as depicted in Map 11.1 of the city of Burns comprehensive plan.

“Water service area” means the water service area as depicted in Map 11.1 of the city of Burns comprehensive plan.
