3.80.010 Mitigation rates imposed.

The Coos Bay fire department shall initiate mitigation rates for the delivery of emergency and non-emergency services by the fire department for personnel, supplies and equipment to the scene of emergency and non-emergency incidents. The mitigation rates shall be based on actual costs of the services and that which is usual, customary and reasonable (UCR), which may include any services, personnel, supplies, and equipment and with baselines established by addendum to the ordinance codified in this chapter. Coos Bay fire department may affix a minimum preparedness and response cost to all incidents when a mitigation billing occurs for a liable or responsible party. [Ord. 597 § 1, 2026].

3.80.020 Associated costs.

All costs associated for apparatus shall be billed at a rate in compliance with the standardized cost schedule established by the Oregon Fire Service Mobilization Plan as identified in Oregon Administrative Rules, Chapter 837-130-0020. Personnel costs will be fully burdened costs and may increase annually based on the annual percentage increase in the Consumer Price Index (CPI), as developed by the Bureau of Labor Statistics of the U.S. Department of Labor. 3.80.030 Claim filing.

A claim shall be filed to the responsible party(s) through their insurance carrier. In some circumstances, the responsible party(s) will be billed directly using the matrix in Appendix A. A compassionate billing procedure will be followed for most incidents involving residents of Coos Bay. The fire department shall be charged with initiating claims either directly, or through a third-party vendor. [Ord. 597 § 3, 2026].

3.80.040 City council rules and regulations.

The city council may make rules or regulations and from time to time may amend, revoke, or add rules and regulations consistent with this chapter, as they may deem necessary or expedient in respect to billing for these mitigation rates or the collection thereof. [Ord. 597 § 4, 2026].
