5.40.010 Recommendation required.

The Oregon Liquor Control Commission requires of every applicant for a license to sell spirits, wines, beers, and other alcoholic liquors a recommendation in writing of the city council. [Ord. 521 § 1, 2018].

5.40.020 Processing fee.

At the time of any license application, change in ownership or change in location, or change in privilege application or renewal or temporary application, the applicant shall pay to the city of Creswell for processing such license application the following applicable fee:

A. Initial original application: $100.00.

B. Change in ownership, change in location, or change in privilege application: $75.00.

C. Renewal or temporary application: $35.00. [Ord. 521 § 1, 2018].

5.40.030 Council action.

A. The council shall provide a written recommendation for each applicant. The council may recommend denial of the license based upon reliable, factual information related to any of the following criteria:

1. Disturbances, lewd or unlawful activities or noise in or on the immediate vicinity or the premises that are related to the sale or service of alcoholic beverages.

2. Applicant has a history or arrest record of alcohol abuse or other controlled substance use.

3. The licensed premises have a history of serious or persistent problems with unlawful activities, noise or disturbances resulting in the need to provide extraordinary police or other city services.

4. Applicant proposes to locate near a licensed child care facility, or elementary or secondary school; a church; a hospital, nursing care facility or convalescent care facility; a park or child-oriented recreational facility; an alcohol or other drug treatment or rehabilitation facility.

5. Applicant fails to provide complete information on OLCC application.

6. Applicant provides false or misleading information.

B. Prior to each annual liquor license renewal period, the city council shall hold a public hearing to allow interested persons the opportunity to provide testimony to be considered by the city council in making its decision to recommend approval or denial of any specific renewal applications. Notice of this public hearing shall be advertised in a local newspaper prior to the hearing. This requirement applies to renewal applications and does not apply to original, change in ownership, location or privilege applications. [Ord. 521 § 1, 2018].
