17.04.010 Title.

A. This title shall be known as the “1982 Eagle Point Zoning Ordinance.”

B. This title shall consist of the text hereof and the map entitled “1982 City of Eagle Point Zoning Map” and identified by the approving signature of the mayor, the chairman of the planning commission and the city recorder of the city of Eagle Point. The map shall also indicate the dates the signatures were affixed. The map and any amendments will be kept on file with the city recorder. If any conflict between the zoning map and this title should arise, the text of the title shall prevail. [Ord. 9-62A § 1, 1982; Ord. 9-52 § 1 (1.010), 1980].

17.04.020 Purpose.

The purpose of this title is to establish for the city of Eagle Point a comprehensive zoning plan designed to provide for implementation of the comprehensive land use plan; to provide for the orderly growth and development of the city; to regulate and control the location and use of land, buildings, and structures for residential, commercial, industrial and other purposes; to regulate and limit the height, number of stories, and percentage of lot coverage of buildings and other structures hereafter erected or altered; to establish minimum setback lines for front, side and rear yards; to establish minimum width and areas for the subdivision or re-subdivision of lands; and to regulate and establish minimum requirements for private garages or parking spaces and commercial loading spaces according to district or zone and type of buildings or structures.

The controls as set forth in this title are deemed the minimum necessary in order to encourage the most appropriate use of land; to conserve and stabilize the value of property; to aid in the rendering of fire and police protection; to provide adequate open spaces for recreation, light and air; to provide for safe pedestrian ways; to lessen the congestion of automotive traffic and parking on streets; to give an orderly growth to the city preventing undue concentration of population thereby aiding in the planning of community utilities and facilities, such as water, sewer and electrical distribution systems, transportation, schools, parks and other public needs and use; and to promote public health, safety and general welfare.

This title repeals and replaces, except as may be provided herein, and supersedes all existing ordinances pertaining to zoning for the city of Eagle Point. Except where otherwise required, the use of the term “title” shall be deemed to refer to this document. Any zoning map duly adopted and existing at the date of the adoption of the ordinance codified in this title shall continue in full force and effect until a new zoning map is adopted whether the same is adopted simultaneously with the ordinance codified in this title or subsequent to the adoption of the ordinance codified in this title. All existing zone classifications shall remain in full force and effect until the same have been changed to conform with the provisions of this title.
