Pursuant to ORS 457.035, the Garibaldi city council, hereinafter referred to as “city,” hereby finds and declares that blighted areas, as defined in ORS 457.010, exist within the city based upon the findings marked Exhibit “A,” attached to the ordinance codified in this section and incorporated by reference as fully set forth herein. 2.45.020 Need.
The city declares and recognizes that there is a need for an urban renewal agency to function within the city of Garibaldi. [Ord. 292 § 2, 2006.]
2.45.030 Powers and limitations.
The city further declares, pursuant to ORS 457.045(2), that all of the rights, powers, duties, privileges and immunities granted to and vested in an urban renewal agency by the laws of the state of Oregon shall be exercised by and vested in the urban renewal agency of the city of Garibaldi; provided, however, that any act of the governing body acting as the urban renewal agency shall be and shall be considered the act of the urban renewal agency only and not of the city council. 2.45.040 Agency title.
The corporate name of the agency created by this chapter shall be, and said agency shall be known as, the “Garibaldi Urban Renewal Agency.” [Ord. 292 § 4, 2006.]
2.45.050 Membership.
The Garibaldi urban renewal agency shall be comprised of nine members, including the five members of the Garibaldi city council as it lawfully exists from time to time; and four at-large positions as prescribed in the agency's bylaws. [Ord. 292 § 5, 2006.]
2.45.060 Urban renewal plan.
A. Findings.
1. That the area described in the Garibaldi urban renewal plan is blighted.
2. That rehabilitation and redevelopment is necessary to protect the public health, safety, or welfare of the city of Garibaldi.
3. That the Garibaldi urban renewal plan conforms to the city's comprehensive plan as a whole, and provides an outline for accomplishing the projects that the Garibaldi urban renewal plan proposes.
4. That provisions have been made to house displaced persons within their financial means and in accordance with ORS 281.045 through 281.105 and, except in the relocation of elderly or handicapped individuals, without displacing on priority lists persons already waiting for existing federally subsidized housing.
5. That no real property has been identified for acquisition at this time, and therefore, that no findings of necessity have been made at this time.
6. That the adoption and carrying out of the urban renewal plan is economically sound and feasible.
7. That the city shall assume and complete any activities prescribed within it by the urban renewal plan.
8. That the Garibaldi city council hereby incorporates by reference the Garibaldi urban renewal plan, attached to the ordinance codified in this section as Exhibit “A,” as support for its above-mentioned findings.
9. That the Garibaldi city council further relies on the report on the Garibaldi urban renewal plan, attached to the ordinance codified in this section as Exhibit “B,” which is incorporated by reference, the report of the planning commission, the public hearing and the entire record before the city council in this matter.
B. Conclusions.
1. The Garibaldi city council hereby adopts and approves the Garibaldi urban renewal plan, pursuant to the provisions of ORS 457, and directs the city recorder to publish notice of the adoption of the ordinance codified in this section in accordance with the requirements of ORS 457.115.
2. The Garibaldi city council directs the city recorder to record a copy of the ordinance codified in this section approving the Garibaldi urban renewal plan with the recording officer of Tillamook County, Oregon, pursuant to ORS 457.125, and directs the city recorder to send a copy of the ordinance codified in this section to the urban renewal agency for the city of Garibaldi, Oregon.
