9.50.010 Definitions.

Definitions for the purposes of this chapter are as follows:

(1) “Enter into or upon” means:

(a) To open or unlock any door, window or other access opening of any motor vehicle, boat or aircraft; or

(b) To be astride of any motor vehicle, boat or aircraft; or

(c) To be supported by any motor vehicle, boat or aircraft.

(2) “Motor vehicle” means any device which is self-propelled or designed for self-propulsion by which a person or property may be transported in, upon, or on the ground.

(3) “Peace officer” means a sheriff, constable, marshal, municipal police officer, member of the Oregon State Police, or investigator of the Criminal Justice Division of the Department of Justice and such other persons as may be designated by law.

9.50.020 Vehicular trespass.

A person commits the crime of vehicular trespass if the person knowingly enters into or upon the motor vehicle, boat or aircraft of another, without the consent of the owner of any person who has a right to possession superior to that of the entrant, when the entrant is not otherwise privileged to do so.

9.50.030 Legal entry.

An entrant is privileged to enter if:

(1) The entrant is attempting to render aid or assistance to an ill or injured person; or

(2) The entrant reasonably believes that the entry is necessary to prevent injury to person or property; or

(3) The entrant is a peace officer, or a person acting under the direction of a peace officer.

9.50.040 Violation—Penalty.

Any violation of this chapter is a “Class B” Misdemeanor.
