15.11.010 Purpose.

This chapter is enacted to adopt the Marion County Public Works Engineering Standards from 1990 to 2023 with respect to driveway and Americans with Disabilities Act (ADA) design and construction standards only. (Ord. 382-2023 § 2 (Exh. A))

15.11.020 Definitions.

(1) “Driveway” means a paved or gravel way that provides access from a public road or other public right-of-way to an abutting property, for the purpose of providing vehicular access to the property.

(2) “Marion County Public Works Engineering Standards” means the engineering standards set forth by Marion County from 1990 to 2023. (Ord. 382-2023 § 2 (Exh. A))

15.11.030 Effect.

(1) Effective as of September 12, 2023, the city has adopted the Marion County Public Works Engineering Standards for driveway and ADA design and construction while the City of Hubbard Design and Construction Standards are being updated.

(2) Prior to issuing a right-of-way permit, the city shall review the design and construction plans for all new or replacement driveways that connect to the right-of-way or public road.

(3) The design and construction standards will need to meet the minimum requirements as outlined in the Marion County Public Works Engineering Standards.

(4) Failure to meet minimum standards will result in a right-of-way permit not being issued.

(5) The city may revoke any right-of-way permit issued under this section if it deems such action will be in the public interest. (Ord. 382-2023 § 2 (Exh. A))
