8.20.010 Purpose.

Because improperly and accidentally ignited fires damage private and public property on the Deschutes River scenic waterway in Jefferson County each summer season, the public would benefit from the adoption of a fire closure season and fire season rules for use of the Deschutes River Scenic Waterway in Jefferson County during the summer season. (Ord. O-88-81 § 1, 1981)

8.20.020 Authority.

The ordinance codified in this chapter is enacted pursuant to the authority granted to general law counties by ORS 203.034. (Ord. O-88-81 § 2, 1981)

8.20.030 Fire season prohibitions.

A.    Season. No person shall build, maintain or keep any fire which is fueled by other than charcoal, gas or petroleum products within the Deschutes River scenic waterway as designated by ORS 390.826, from June 1st to October 1st. Fire must be contained in a firepan or similar device of metal.

B.    Equipment. Every overnight camp or overnight hiking party or person using fire or operating a motor driven vehicle or boat within the Deschutes River scenic waterway as designated by ORS 390.826, from June 1st to October 1st, shall carry and keep reasonably accessible one bucket of at least one gallon capacity and one spade or shovel. 8.20.040 Prosecution of violations—Penalties.

A.    Prosecution. Offenses committed in violation of this chapter shall be prosecuted in the manner provided in ORS 203.810.

B.    Penalties. Any person convicted of a violation of any provision of this chapter shall be subject to a fine not to exceed five hundred dollars ($500.00). (Ord. O-88-81 § 4, 1981)

8.20.050 Enactment provisions—Conformance with law.

Except as expressly provided herein, this chapter shall in no way be a substitute for or eliminate the necessity of conforming with any and all state and federal laws, rules and regulations, and other ordinances which are now or may be in the future, in effect, which relate to the requirements provided in this chapter.
