2.55.010 Title.
This chapter shall be known as Formation of Josephine County – City of Grants Pass Solid Waste Agency, an Intergovernmental Entity. [Ord. 2001-3 § 1.]
2.55.020 Ratification of formation.
The Josephine County Board of Commissioners hereby ratifies the formation of an intergovernmental entity pursuant to the terms of ORS Chapter 190. The newly formed entity is to be called Josephine County – City of Grants Pass Solid Waste Agency. It is the intention of the Josephine County Board of Commissioners to enter into an intergovernmental agreement with the City of Grants Pass that will provide for the formation of the Josephine County – City of Grants Pass Solid Waste Agency and set out the duties, powers, and functions of the entity. 2.55.030 Effective date of intergovernmental agreement.
The effective date of the intergovernmental agreement for formation of Josephine County – City of Grants Pass Solid Waste Agency is September 12, 2001. [Ord. 2001-3 § 1(B).]
2.55.040 Public purpose for which the intergovernmental entity is formed.
The public purposes for which the intergovernmental entity is formed are as follows:
A. To provide and uniformly administer solid waste franchise management services within Josephine County, including the City of Grants Pass;
B. To promote accountability, continuity and efficiency in the use and allocation of environmental program fees collected under solid waste franchise agreements within Josephine County and the City of Grants Pass. [Ord. 2001-3 § 1(C).]
2.55.050 Powers, duties and functions of Josephine County – City of Grants Pass Solid Waste Agency.
Josephine County – City of Grants Pass Solid Waste Agency shall have as its function the duty and power to do the following things:
A. Provide through a cooperative system, oversight, administration, regulation, and allocation of resources from the environmental program fee collected through solid waste franchises within Josephine County, including the City of Grants Pass, and to conduct audits on behalf of both parties to the intergovernmental agreement.
B. Perform any functions and activities that any party to the intergovernmental agreement forming Josephine County – City of Grants Pass Solid Waste Agency has the authority to perform with respect to the provision for services.
C. Perform all lawful acts that are necessary to fulfill the purposes set out above. [Ord. 2001-3 § 1(D).]
