19.69C.010  Purpose.

The purpose of this overlay is to facilitate development which is compatible with the requirements of the state and federal scenic waterways program. [2005 RLDC § 69.310.]

19.69C.020  Siting standards.

Any use permitted in a zone shall be allowed on lands adjacent to the Rogue River and Illinois River scenic waterways; provided, that:

A. If the property is located within one-quarter mile of the mean high water line of the river, or within the river proper between the high water marks, no development permit shall be issued unless the applicant has obtained a notice to proceed from the Scenic Rivers Program, Parks Division, Oregon Department of Transportation; or the time limit for state acquisition has expired;

B. If the property is located within the legal boundaries of the Rogue River/Illinois River National Wild and Scenic River, as established by Act of Congress, a copy of the proposed application shall be transmitted to the administering federal agency. If the property is subject to a scenic easement, no development permit shall be issued unless the applicant has obtained an authorization from the administering agency;

C. No building located within one-quarter mile of the mean high water line of the river or within the river proper between the high water line shall exceed a height of 30 feet, except as provided in JCC 19.72.030(B), or the structure is screened from the river by topography or vegetation. 19.69C.030  Property development standards.

The property development standards in the underlying zone shall apply to all development in this overlay. The standards contained in this chapter shall be in addition to the standards of the underlying zone. [2005 RLDC § 69.330.]
