5.45.010 Definitions.

The following definitions shall apply:

“Newspaper collection box” means any box, container, or device which is used for the collection of newspaper deposited by the general public and intended for recycling.

“Owner” means any organization, corporation, partnership or any other entity which places, maintains, controls and/or manages newspaper collection boxes. [Ord. 941 § 1, 1990.]

5.45.020 Permit.

It shall be unlawful for any owner of a newspaper collection box to place such box on city-owned property or within roadway rights-of-way within the city of Junction City without first obtaining a permit from the superintendent of public works of the city of Junction City.

The permit application shall contain the following information: name of the organization or person making application, address, phone number, responsible person’s name, address and phone number, and assigned box number. Further, the owner of the collection box must notify the city recorder, within 10 working days, if there is any change in the above information. [Ord. 941 § 2, 1990.]

5.45.030 Regulations.

The placement of newspaper collection boxes within roadway rights-of-way within the city of Junction City, or on property owned by the city of Junction City, shall be by permit only and comply with the following:

A. Newspaper collection boxes shall not exceed 40 inches maximum height with a mean height of 35 inches for the box cover, eight feet in length, nor three feet in width.

B. Newspaper collection boxes shall be identified by a sign stating the box number, type of material to be deposited, and the name of the owner.

C. Newspaper collection boxes shall be located only behind the curb on streets with parking medians and behind the sidewalk on a curbside sidewalk on a fully developed roadway right-of-way. Permission by the abutting property owner shall be transmitted in writing to the superintendent of public works at the time of permit application.

D. Newspaper collection boxes shall be constructed of weatherproof, or exterior grade, materials. Boxes shall be kept in good repair and repainted as needed for a good appearance. Colors to be white or earth tones only.

E. Newspaper collection boxes shall have easily operated closures to fully contain the deposited material; the site shall be kept free of rubbish.

F. Newspaper collection box owners will furnish a schedule of minimum pick-up services for the box with the permit application.

G. Enforcement.

1. If the collection box is not in compliance with the regulations of this chapter, the superintendent of public works may require that it be removed.

2. If the property owner from whom the permission was granted revokes that permission, the superintendent of public works will require the collection box to be removed.

3. The city may remove the collection box at the expense of the owner. [Ord. 941 § 3, 1990.]

5.45.040 Penalty.

The penalty for violating any provision of this chapter shall be a fine not to exceed $500.00. [Ord. 941 § 4, 1990.]
