13.16.010 Definition.

As used in this chapter, the term “person” means an individual, firm, partnership, corporation or association. (Ord. 78-43 § 1)

13.16.020 Prohibited acts.

A. As provided for in ORS 448.300, no person shall do any act which pollutes or is likely to impair the purity of the municipal water supply.

B. Acts prohibited by subsection (A) of this section shall include but not be limited to:

1. The injury to or destruction of a municipal water facility or appurtenances thereto;

2. The depositing of petroleum products; industrial wastes; animal carcasses or parts thereof; excrement; sewage; putrid, decaying or deleterious substances; garbage, litter or other noxious or unwholesome matter in waters or on property owned by the city, as provided for by ORS 448.295. 13.16.030 Violation – Penalty – Alternative remedies.

A. Any person violating any provisions of this chapter shall be sanctioned under the provisions of the city’s violation ordinance (Chapter 1.16 LCMC). Any violation shall be classified as a Class B violation. Any conviction shall bear an assessment of $500.00. Each day that any person violates any provisions of this chapter shall be deemed a separate offense.

B. The city may, as an alternative to other remedies that are legally available, institute an injunctive, abatement or other appropriate proceeding to enjoin temporarily or permanently, prevent, abate or remove any violation. (Ord. 2015-10 §§ 5, 6; Ord. 78-43 § 3)
