17.12.010 Classification of zones.

A. For the purpose of this title, the following zones are hereby established in the city:

B. The adoption of Ordinance No. 2016-20 recognized the changing nature of the vacation rental dwelling market from second homes to business investments, the changes to the city’s housing mix, and the city’s desire to limit the influx of vacation rental dwellings in some areas of the city. Therefore, as of the effective date of Ordinance No. 2016-20, no additional properties may be zoned into the vacation rental (VR) zone. Areas zoned vacation rental (VR) prior to the effective date of Ordinance No. 2016-20 may retain that zoning designation. 17.12.020 Location of zones.

The boundaries for the zones listed in this title are indicated on a map entitled “Zoning Map of Lincoln City, Oregon,” which is attached as Exhibit “A” to the ordinance codified in this title and is incorporated herein as though fully set forth. (Ord. 92-3 § 1; Ord. 84-2 § 2.020)

17.12.030 Boundaries of zones.

If a zone boundary as shown on the zoning map divides a lot between more than one zone, the property owner shall utilize one of the two following options in the development of the lot and shall so specify the chosen option on land use and/or permit applications:

1. The entire lot shall be deemed to be in the zone in which the greater area of the lot lies; or

2. Each portion of the lot shall be used and developed in accordance with the designated zone of that portion of the lot. (Ord. 2022-38 § 2; Ord. 2020-15 § 4; Ord. 92-3 § 1; Ord. 84-2 § 2.030)

17.12.040 Severability.

The provisions of this title are severable. If any section, clause or phrase of this title is adjudged by a court of competent jurisdiction to be invalid, the decision shall not affect the validity of the remaining portions of this title. (Ord. 92-3 § 1; Ord. 84-2 § 2.040)

17.12.050 Zoning of annexed areas.

When requesting annexation of an area, a request for a city zoning designation shall be made and shall be processed concurrently with the annexation application. (Ord. 2020-15 § 5; Ord. 92-3 § 1; Ord. 84-2 § 2.050)
