RESOLUTIONS

10.01 Actions Requiring a Resolution.

In addition to other acts required by law, or the Monmouth City Code, to be done by resolution, those acts of the Council shall be by resolution which:

10.01.1 Cover traffic regulations, including, but not limited to establishing traffic control devices;

10.01.2 Establish or amend utility rates, fines, filing fees, costs, user fees, charges or penalties;

10.01.3 Adopts a budget;

10.01.4 Monmouth City Code requires or allows to be by resolution;

10.01.5 Repeals or amends another resolution;

10.01.6 Executes established law;

10.01.7 Deal with matters of a temporary or special nature and are restrictive in their operation and effect;

10.01.8 In the opinion of the City Attorney, are to be done by resolution; and

10.01.9 The Council’s characterization that a matter is to be dealt with by resolution is controlling, regardless of the nature of the action, unless otherwise provided in this Charter.

10.02 Enacting Clause.

The enacting clause of all resolutions shall be, “Be it resolved by the City Council of the City of Monmouth, Oregon, as follows:”.

10.03 Mode of Enactment.

Every resolution shall be read at one meeting by title only. That reading shall be in full if so requested by the Mayor or a Councilor. The vote shall be by roll call. A resolution enacted after being read by title alone shall have no legal effect if it differs materially from its terms as it was filed prior to its reading, unless each section which includes such a difference is read fully and distinctly as finally amended prior to adoption.

10.04 Signatures.

Upon enactment of a resolution the recorder shall sign with the date of its passage and the Mayor shall immediately thereafter sign and insert the date of the Mayor’s signature as an acknowledgment that the resolution was in fact passed by the Council. The Mayor shall not have a vote on a resolution except in the case of a tie vote. The Mayor shall not have the power to veto a resolution.

10.05 When Resolution Takes Effect.

A resolution shall be effective immediately upon its passage. However, when the Council deems it advisable, a resolution may provide a later date for it to take effect.
