UTILITIES

14.01 City Utility Systems.

The City is authorized and empowered to do all things necessary, including, but not limited to, the power to acquire, buy, appropriate, condemn, construct, erect, install, own, manage, operate, and maintain, within or without the corporate limits of the City the following systems:

14.01.1 Electric light and power system;

14.01.2 Sanitary sewer;

14.01.3 Storm sewer;

14.01.4 Water;

14.01.5 Street and sidewalks;

14.01.6 Parks;

14.01.7 Fiber optic cable; and

14.01.8 Such other utility systems as the Council deems necessary and appropriate.

14.02 Expenditure of Income.

The income derived from the operation of a utility system shall be used, disposed of and expended in the following order:

14.02.1 For the payment of the necessary costs and expenses of operating such a system, including necessary repairs and betterments;

14.02.2 For making extensions and additions to said system;

14.02.3 For establishing a reserve fund adequate for any ordinary emergency and implementation of a capital program; and

14.02.4 When permissible under the laws of the State of Oregon, for the reduction of general property taxes within the City.

14.03 Vote Required for Disposal of Electric System.

The City shall grant no franchise to any person, firm or corporation to operate an electric system within the City and shall not sell or lease or in any manner dispose of the electric system, or any portion thereof, except useless or non-essential parts thereof without the consent of the majority of the registered voters in the City.
